Main measures: to propose a Directive on road infrastructure safety, draw up technical guidelines concerning audit methods, urban safety management and speed-moderation techniques, draw up good practice guidelines for level-crossings, carry out research and demonstration projects on 'intelligent roads', carry out safety impact assessments of new projects, improve safety levels in tunnels, etc.

Indicators for an effective nuclear safety culture include, in particular: the commitment at all levels of staff and management within an organisation to nuclear safety and its continuous improvement; the promotion of the ability of staff at all levels to question the delivery of relevant safety principles and practices to continuously improve nuclear safety; the ability of staff to report safety issues in a timely manner; the identification of the lessons learnt from operational experience; and the systematic reporting of any deviation from normal operating conditions or arrangements relevant to accident management that have the potential to have an impact on nuclear safety.

(2) Directive 2004/49/EC established a common regulatory framework for railway safety, through harmonisation of the content of safety rules, the safety certification of railway undertakings, the tasks and roles of the national safety authorities and the investigation of accidents.

The Agency or, in the cases referred to in paragraph 2a, the national safety authority, shall inform the national safety authorities within one month of the issue, renewal, amendment or revocation of a single safety certificate. It shall state the name and address of the railway undertaking, the issue date, the scope and validity of the certificate and, in the case of revocation, the reasons for its decision.

The remaining recitals justify the provisions of the enacting terms, while referring to Article 2(b) EURATOM (according to which the Community is to establish uniform safety standards to protect the health of workers and of the general public and ensure that they are applied) and Article 30 (quoted above). The actions to be reported should include relevant information with regard to the monitoring of safety performance, the compliance with applicable safety regulatory requirements by the organisations supervised, the programme of safety regulatory audits, the review of the safety arguments, the changes to functional systems implemented by the organisations in accordance with procedures accepted by the authority and the safety directives issued by the national supervisory authority.

National supervisory authorities shall keep and maintain access to, the appropriate records related to their safety oversight processes, including the reports of all safety regulatory audits and other safety-related records related to certificates, designations, the safety oversight of changes, safety directives and the use of recognised organisations.

Directive 2004/49/EC of the European Parliament and of the Council of 29 April 2004 on safety on the Community’s railways requires infrastructure managers and railway undertakings to establish their safety management systems in such a way that the railway system is at least able to achieve the common safety targets and comply with the national safety rules and safety requirements defined in the technical specifications for interoperability (TSIs) and that the relevant parts of the common safety methods are applied.

As a result of conciliation, the Commission's powers to scrutinise new national safety rules was considerably strengthened: it was given the power to suspend the application of a national safety rule for a maximum period of six months if there is a serious doubt about the compatibility of draft safety rules with the European rules or if the Commission considers that it constitutes a means of arbitrary discrimination or a disguised restriction on rail transport operation between Member States. The final verdict on the conformity of new national safety rules with Community legislation lies with a regulatory committee.

At the present stage of harmonisation and in view of inadequately defined common safety management processes, safety authorities must be given an opportunity to re‑examine safety management in the light of their specific national requirements and, if necessary, to demand additional adjustments (e.g. emergency management for tunnel routes, requirements based on climatic conditions etc.), if necessary. High-altitude routes in the Alps, for example, which are often more than 100 years old, are fundamentally different from tunnel routes in other countries because of special safety-related requirements for infrastructure, technology and personnel.
