Welcomes the agreements with Montenegro and Croatia allowing the extradition of citizens of these countries suspected of taking part in organised crime and the foreseen talks on the demarcation of the border between Serbia and Croatia; encourages the Serbian Government to conclude similar agreements with other neighbours and welcomes the steps taken to this end by Serbia and Montenegro; encourages Serbia to continue sharing intelligence and evidence on cross-border crime networks, particularly those involved in drug-trafficking, with neighbouring countries in order to effectively fight transnational organised crime in the Balkan region;

In addition, the list set out in Annex I to Decision 2004/211/EC should take account of the separation of the customs territories of Montenegro and Serbia and those two third countries should be listed separately, thus allowing the importation of live equidae, their semen, ova and embryos from both Montenegro and Serbia under the same additional conditions as specified at present for ‘Serbia and Montenegro’ in that Annex.

The Thessaloniki European Council of June 2003 approved the ‘Thessaloniki Agenda for the Western Balkans: moving towards European integration’, which provided for Community programmes to be opened up to the Stabilisation and Association Process (SAP) countries along the lines established for the participation of candidate countries.In its communication on ‘Preparing for the participation of the Western Balkan countries in Community programmes and agencies’, the Commission advocated concluding with Albania, Bosnia and Herzegovina, Croatia, the Former Yugoslav Republic of Macedonia and Serbia and Montenegro framework agreements laying down the general principles governing each country’s participation in Community programmes.In accordance with the negotiating directives adopted by the Council on 29 April 2004, the Commission, on behalf of the Community, has negotiated a Framework Agreement with Serbia and Montenegro on the general principles for its participation in Community programmes.This Agreement was signed, on behalf of the Community, on 22 November 2004 in Brussels, subject to conclusion at a later date.With regard to some of the programmes covered by the Agreement, the Treaty does not provide for powers other than those under Article 308.The specific terms and conditions regarding the participation of Serbia and Montenegro in the Community programmes, including the financial contribution payable, should be determined by the Commission on behalf of the Community.

The Framework Agreement between the European Community and Serbia and Montenegro on the general principles for the participation of Serbia and Montenegro in Community programmes is hereby approved on behalf of the Community.

If it is now being proposed that the European Agency for Reconstruction, which was originally intended for Kosovo, now be extended to include Serbia and Montenegro and if there are also calls for Kosovo, Serbia and Montenegro to be made more dependent on one another by creating a common energy supply, this raises the question as to whether Serbia has been promised that it will get Kosovo back in exchange for adapting to and integrating into the EU. If this is the case, it will not only evoke a lot of resistance within Serbia but will in particular cause uncontrollable anger on the part of the deceived inhabitants of Kosovo.
