Service contracts, in particular in the sphere of property management services, may, in certain circumstances, include works. However, in so far as such works are incidental to the principal subject-matter of the contract, and are a possible consequence thereof or a complement thereto, the fact that such works are included in the contract does not justify the qualification of the service contract as a works contract.

(19) The national regulatory body should function in a way which avoids any conflict of interests and any possible involvement in the award of the public service contract under consideration, without prejudice to the option of this body being funded from the national budget or from levies on the rail sector and to the publication of the relevant information . The competence of the regulatory body should be extended to allow the assessment of the purpose of an international service and, where appropriate, the potential economic impact on existing public service contracts.
(19) De nationale toezichthoudende instantie moet op zodanige wijze te werk gaan, dat belangenverstrengeling of enige betrokkenheid bij de gunning van het openbaredienstcontract ter zake vermeden wordt, onverminderd de mogelijkheid om de instantie uit de algemene begroting van de lidstaat of uit aan de spoorwegsector opgelegde heffingen te financieren en onverminderd het bekend maken van relevante informatie . The award of contracts concluded in the Member States by contracting entities as referred to in Directive 2004/17/EC of the European Parliament and of the Council of 31 March 2004 coordinating the procurement procedures of entities operating in the water, energy, transport and postal services sectors and by contracting authorities as referred to in Directive 2004/18/EC of the European Parliament and of the Council of 31 March 2004 on the coordination of procedures for the award of public works contracts, public supply contracts and public service contracts is subject to compliance with the principles of the Treaty and in particular the free movement of goods, the freedom of establishment and the freedom to provide services, and with the principles deriving therefrom, such as the principles of equal treatment, non-discrimination, mutual recognition, proportionality and transparency.

(28) Taking into account the further opening up of Community postal services to competition and the fact that such services are provided through a network by contracting authorities, public undertakings and other undertakings, contracts awarded by contracting entities providing postal services should be subject to the rules of this Directive, including those in Article 30, which, safeguarding the application of the principles referred to in recital 9, create a framework for sound commercial practice and allow greater flexibility than is offered by Directive 2004/18/EC of the European Parliament and of the Council of 31 March 2004 on the coordination of procedures for the award of public works contracts, public supply contracts and public service contracts(11).

(19 ) As regards public service contracts, full application of this Directive should be limited, for a transitional period, to contracts where its provisions will permit the full potential for increased cross-frontier trade to be realised. Contracts for other services need to be monitored during this transitional period before a decision is taken on the full application of this Directive.
(19) Wat overheidsopdrachten voor diensten betreft, moet gedurende een overgangsperiode de volledige toepassing van deze richtlijn worden beperkt tot opdrachten waarvoor de bepalingen van deze richtlijn de mogelijkheden tot uitbreiding van het verkeer over de grenzen heen ten volle garanderen. In the light of the definition, dynamic purchasing systems are suited solely to ‘normal’, i.e. simple, standardised, procurement procedures, and at all events not to works contracts, more complex service contracts or contracts for intellectual-creative services.

If a successful appeal is made against a preliminary decision of a competent authority, and if it would not be possible to award a new public service contract in accordance with the Regulation prior to the expiry of the existing arrangement, the competent authority shall be entitled to extend the existing arrangement until such time as it is possible to award a new public service contract.
Indien met succes beroep is ingesteld tegen een voorlopig besluit van een bevoegde instantie en indien het niet mogelijk is vóór het verstrijken van de bestaande regeling een nieuw openbare-dienstcontract overeenkomstig de verordening te sluiten, heeft de bevoegde instantie het recht de bestaande regeling te verlengen totdat het mogelijk is een nieuw openbare-dienstcontract te sluiten.
