De door Procter Gamble voorgestelde test, volgens welke eerst dient te worden nagegaan welke de gebruikelijke aanbiedingsvorm op de markt van de betrokken waar is, en vervolgens of de als merk aangevraagde vorm in de ogen van de consument daarvan merkbaar verschilt, zou de facto betekenen dat een driedimensionaal merk moet worden ingeschreven zodra het verschilt van elke andere vorm, hetgeen in strijd zou zijn met artikel 7, lid 1, sub b, van verordening nr. 40/94.
