On 15 November 2012, the Commission notified Sri Lanka pursuant to Article 32 of the Regulation (EC) No 1005/2008 that it considered the possibility of identifying Sri Lanka as a non-cooperating third country and invited Sri Lanka to establish an action plan in close cooperation with its services to rectify the shortcomings identified in the Decision of 15 November 2012.

Calls on the Government of Sri Lanka, the United National Party and other parties to agree to work in close cooperation to take robust action against terrorism and to address legitimate Tamil grievances, and to come forward with a bold gesture of reconciliation towards the Tamil peoples of Sri Lanka; considers that a major step in creating the right framework for such action would be early revision of the Constitution of Sri Lanka, as one of Asia's longest-standing democracies, to define the state as a secular, democratic republic in which all religions are respected;

Is worried at the fact that a deal to share international aid has still not been implemented, and believes that aid sent to Sri Lanka by the EU, and other international donors, in response to the tsunami must benefit the victims of that disaster without regard for their ethnic or religious denomination; but is concerned about the distribution and use of tsunami funds, which have not had the expected impact on the everyday lives of the victims or on Sri Lanka's recovery; notes that the political gridlock on the 'Post-Tsunami Operations Management Structure' has already delayed the release of a further EUR 50 million in aid, hindering reconstruction work in the North and East of Sri Lanka;

Acknowledges the bold steps taken by the Government of Sri Lanka and the LTTE to create the conditions in which negotiations may lead to a political solution and a lasting peace, on the basis of the Oslo Declaration of December 2002, where the Government of Sri Lanka and the LTTE agreed to explore a solution based on a federal structure within a united Sri Lanka;
