The Commission sets out the criteria for assessment under Article 101(3) of the Treaty on the Functioning of the European Union (TFEU) (ex-Article 81(3) of the Treaty Establishing the European Community (TEC)) with a view to exempting agreements between undertakings, decisions by associations of undertakings and concerted practices, which are prohibited under Article 101(1) TFEU (ex-Article 81(1) TEC).

Should the new entity and A-TEC try to coordinate their competitive behaviour, it can indeed not be fully excluded that A-TEC's position as a minority shareholder might provide A-TEC with access to information on NA which it would not have if such a shareholder relationship did not exist.

While Art. 62 TEC is the legal basis for regulations relating to border controls and visa policy, Art. 63 paragraph 3 TEC refers explicitly to measures on illegal immigration and illegal residence, including repatriation of illegal residents.

Bovendien heeft het Hof reeds bij verschillende gelegenheden geoordeeld dat artikel 296 van het EG-Verdrag geen automatische vrijstelling verleent op defensiegebied[11]. Integendeel, een vrijstelling wordt wettelijk gebaseerd op artikel 296 van het EG-Verdrag, wat betekent dat voor de artikelen op de lijst vrijstelling kan worden verleend als en slechts als aan de voorwaarden voor het beroep op artikel 296 van het EG-Verdrag is voldaan[12].
