Where some technical information is so sensitive that it would be inappropriate to include it in the category of technical documentation as detailed in delegated acts adopted pursuant to this Regulation, market surveillance authorities should retain the power to access that information when necessary in accordance with the duty of cooperation on suppliers or by way of additional parts of the technical documentation uploaded to the product database by suppliers on a voluntary basis.
Indien bepaalde technische informatie zo gevoelig is dat het ongepast zou zijn ze op te nemen in de categorie technische documentatie, zoals nader omschreven in de op grond van deze verordening vastgestelde gedelegeerde handelingen, moeten de markttoezichtautoriteiten de bevoegdheid behouden om zo nodig toegang tot die informatie te krijgen, conform de voor leveranciers geldende samenwerkingsverplichting of via aanvullende technische documentatie die op vrijwillige basis door de leveranciers in de productendatabank is opgenomen.

The Commission should also be empowered to adopt implementing technical standards developed by ESMA, with regard to the standard forms, templates and procedures for the notification of the certificate of approval, the prospectus, registration document, universal registration document, any supplement thereto and the translation thereof, the supplement of the prospectus, and the translation of the prospectus and/or summary, the standard forms, templates and procedures for the cooperation and exchange of information between competent authorities, and the procedures and forms for exchange of information between competent authorities and ESMA. The Commission should adopt those implementing technical standards by means of implementing acts pursuant to Article 291 TFEU and in accordance with Article 15 of Regulation (EU) No 1095/2010.

Due to the technical nature of those implementing acts, the examination procedure should be used for the adoption of implementing acts concerning the introduction of European Professional Cards for particular professions, the format of the European Professional Card, the processing of written applications, the translations to be provided by the applicant to support any application for a European Professional Card, details of documents required under Directive 2005/36/EC to present a complete application, procedures for making and processing payments for that Card, rules for how, when and for which documents competent authorities may request certified copies for the profession concerned, the technical specifications and the measures necessary to ensure integrity, confidentiality and accuracy of information contained in the European Professional Card and in the IMI file, the conditions and the procedures for issuing a European Professional Card, rules concerning the conditions of access to the IMI file, the technical means and the procedures for the verification of the authenticity and validity of a European Professional Card, and the application of the alert mechanism.
Wegens de technische aard van die uitvoeringshandelingen moet de onderzoeksprocedure worden toegepast voor de vaststelling van uitvoeringshandelingen betreffende de invoering van de Europese beroepskaart voor bepaalde beroepen, het formaat van de Europese beroepskaart, de verwerking van schriftelijke aanvragen, de vertalingen die door de aanvrager moeten worden verstrekt om een aanvraag voor een Europese beroepskaart te ondersteunen, de gegevens betreffende de krachtens Richtlijn 2005/36/EG vereiste documenten om een volledige aanvraag te kunnen indienen, de procedures betreffende de manier waarop betalingen voor die kaart kunnen worden verricht en verwerkt, de regels omtrent de vraag hoe, wanneer en voor welke documenten de bevoegde autoriteiten voor het betreffende beroep voor eensluidend gewaarmerkte afschriften kunnen verlangen, de technische specificaties en de maatregelen die nodig zijn om de integriteit, vertrouwelijkheid en nauwkeurigheid van de informatie op de Europese beroepskaart en in het IMI-bestand te waarborgen, de voorwaarden en procedures voor de afgifte van een Europese beroepskaart, de regels betreffende de voorwaarden voor toegang tot het IMI-bestand, de technologische middelen en de procedures voor de verificatie van de authenticiteit en de geldigheid van een Europese beroepskaart en de toepassing van het waarschuwingsmechanisme, de onderzoeksprocedure worden toegepast.

Member States shall put in place the necessary technical means allowing them to process electronically signed documents that service providers submit in the context of completing procedures and formalities through the Points of Single Contact as foreseen by Article 8 of Directive 2006/123/EC, and which are signed by competent authorities of other Member States with an XML or a CMS or a PDF advanced electronic signature in the BES or EPES format, that complies with the technical specifications set out in the Annex.

Member States shall put in place the necessary technical means allowing them to process electronically signed documents that service providers submit in the context of completing procedures and formalities through the Points of Single Contact as foreseen by Article 8 of Directive 2006/123/EC, and which are signed by competent authorities of other Member States with an XML, a CMS or a PDF advanced electronic signature at any conformance level or using an associated signature container at basic level provided these comply with the technical specifications listed in the Annex.

suppliers shall make technical documentation available to the authorities of Member States on request, for a period ending five years after the last tyre of a given tyre type has been made available on the market; the technical documentation shall be sufficiently detailed so as to allow the authorities to verify the accuracy of information provided on the label on fuel efficiency, wet grip and external rolling noise;

After announcing the end of negotiations and informing all the participants thereof, the contracting authorities shall check, by applying the selection criteria already set in accordance with paragraph 2, whether the candidates’ economic, financial and technical capacity is appropriate to the technical solution specified in the final contract documents. Where the economic, financial or technical capacity of one or more candidates, as proven at the request to participate in negotiations, is not appropriate to the technical solution, contracting authorities shall make a written request to the candidates concerned to present the necessary documentation to allow a check to be carried out, on the basis of the above mentioned criteria, as to whether they have the capacity adapted to the retained technical solution.
7. Nadat de aanbestedende diensten de onderhandelingen met alle deelnemers voor beëindigd hebben verklaard en dezen daarvan in kennis hebben gesteld, gaan zij aan de hand van de overeenkomstig lid 2 reeds vastgestelde selectiecriteria na of de economische en financiële draagkracht en de technische bekwaamheid van de gegadigden aan de in het definitieve bestek gespecificeerde technische oplossing beantwoorden. Ingeval de economische en financiële draagkracht of de technische bekwaamheid van een of meer gegadigden, zoals deze bij de aanvraag tot deelneming aan de onderhandelingen zijn aangetoond, niet aan deze technische oplossing beantwoorden, nodigen de aanbestedende diensten de betrokken gegadigden schriftelijk uit, de nodige documentatie te verstrekken teneinde op grondslag van vorengenoemde criteria na te gaan of zij over de passende draagkracht en bekwaamheid voor de gekozen technische oplossing beschikken.

Nadat de aanbestedende diensten de onderhandelingen met alle deelnemers voor beëindigd hebben verklaard en dezen daarvan in kennis hebben gesteld, gaan zij aan de hand van de overeenkomstig lid 2 reeds vastgestelde selectiecriteria na of de economische en financiële draagkracht en de technische bekwaamheid van de gegadigden aan de in het definitieve bestek gespecificeerde oplossing beantwoorden. Ingeval de economische en financiële draagkracht of de technische bekwaamheid van een of meer gegadigden, zoals deze bij de aanvraag tot deelneming aan de onderhandelingen zijn aangetoond, niet aan deze oplossing beantwoorden, nodigen de aanbestedende diensten de betrokken gegadigden schriftelijk uit, de nodige documentatie te verstrekken teneinde op grondslag van vorengenoemde criteria na te gaan of zij over de bekwaamheid beschikken om de in het definitieve bestek uiteengezette oplossing uit te voeren.

Where the economic, financial or technical capacity of one or more candidates, as proven at the request to participate in negotiations, is not appropriate to the technical solution, contracting authorities shall make a written request to the candidates concerned to present the necessary documentation to allow a check to be carried out, on the basis of the above mentioned criteria, as to whether they have the capacity adapted to the retained technical solution. Article 44(5) shall apply.
Ingeval de economische en financiële draagkracht of de technische bekwaamheid van een of meer gegadigden, zoals deze bij de aanvraag tot deelneming aan de onderhandelingen zijn aangetoond, niet aan deze technische oplossing beantwoorden, nodigen de aanbestedende diensten de betrokken gegadigden schriftelijk uit, de nodige documentatie te verstrekken teneinde op grondslag van vorengenoemde criteria na te gaan of zij over de passende draagkracht en bekwaamheid voor de gekozen technische oplossing beschikken. Artikel 44, lid 5, is van toepassing.
