Is deeply concerned by the Court of Auditors' conclusion that there are continuing weaknesses in national customs supervision and that it cannot, therefore, be ensured that the TOR recorded are complete and correct; finds it unacceptable that the control of customs procedures in Member States is not functioning properly; recalls that the correct operation of customs procedures has direct consequences in terms of the calculation of the value added tax; is deeply worried by the Court of Auditors' finding in Special Report No 13/2011 that the application of customs procedure 42 alone accounted for extrapolated losses of approximately EUR 2 200 million in 2009 with regard to the seven Member States which were audited, representing 29 % of the VAT theoretically applicable on the taxable amount of all the imports made under customs procedure 42 in 2009 in those seven Member States;

Welcomes the simplified customs control system that was introduced in 2009, and recognises its importance in facilitating international trade; stresses that the widespread use of simplified customs procedures for imports, which tend to reduce customs formalities and control before the release of goods, is one of the key elements of the EU's customs policy; recalls that over 70% of all customs procedures have been simplified; finds it regrettable, however that those procedures have led to unjustified levels of loss to the EU budget and breaches of EU trade policy;

If the goods have been entered for a customs procedure which has not been discharged, and the place cannot be determined, pursuant to the second or third subparagraphs of paragraph 1, within a specified period of time, the customs debt shall be incurred at the place where the goods were either placed under the procedure concerned or were introduced into the customs territory of the Community under that procedure.

Instead of the measures laid down in paragraphs 2 and 3, the customs authorities shall have the option of deeming a declaration invalid where it is clear that the declarant's refusal to be present at the examination of the goods or to designate a person able to give the necessary assistance neither prevents, nor seeks to prevent, those authorities from finding that the rules governing the entry of the goods for the customs procedure concerned have been breached, and neither evades, nor seeks to evade, the provisions of Article 66 (1) or Article 80 (2) of the Code.

De douaneautoriteiten kunnen, in plaats van over te gaan tot de in de leden 2 en 3 bedoelde maatregelen, de aangifte buiten werking stellen, mits er geen vermoeden bestaat dat de weigering van de aangever bij het onderzoek aanwezig te zijn of een persoon aan te wijzen die de nodige bijstand kan verlenen ten doel of tot gevolg heeft dat de vaststelling wordt verhinderd van een inbreuk op de voorschriften betreffende de plaatsing van de goederen onder de betrokken douaneregeling of dat artikel 66, lid 1, of artikel 80, lid 2, van het Wetboek kan worden toegepast.
