TRADUCTIONS EN CONTEXTE

The legal basis to be used for the establishment of a Community patent jurisdiction was introduced into the EC Treaty by Article 2 (26 ff.) of the Treaty of Nice amending the Treaty on European Union, the Treaties establishing the European Communities and certain related acts which entered into force on 1 February 2003, inserting Article 229a and Article 225a into the EC Treaty.

(17) In accordance with Article 3 of the Protocol on the position of the United Kingdom and Ireland, annexed to the Treaty on European Union and the Treaty establishing the European Community, the United Kingdom and Ireland have notified their wish to take part in the adoption and application of this Directive.

The United Kingdom is taking part in this Decision, in accordance with Article 5 of the Protocol integrating the Schengen acquis into the framework of the European Union annexed to the Treaty on European Union and to the Treaty establishing the European Community and Article 8(2) of Council Decision 2000/365/EC of 29 May 2000 concerning the request of the United Kingdom of Great Britain and Northern Ireland to take part in some of the provisions of the Schengen acquis , to the extent that its measures develop provisions of the Schengen acquis against the organisation of illegal immigration in which the United Kingdom participates, and the Protocol on the position of the United Kingdom and Ireland annexed to the Treaty on European Union and to the Treaty establishing the European Community, having notified under Article 3 thereof its wish to take part in the adoption and application of this Decision.

The report is based on Article 150 of the Treaty establishing the European Community, which provides for, in a vague and debatable manner, the implementation of a European vocational training policy ‘while fully respecting the responsibility of the Member States’.

In order, however, to continue to really take youth policy forward, it is necessary to explicitly enshrine this goal in the Treaty establishing the European Community. The next Intergovernmental Conference represents an opportunity to adopt a specific article on youth policy, which could provide at least for the Community to promote cooperation between Member States and, where necessary, to complement their activities.
Om echt verder te komen met het jongerenbeleid is het echter noodzakelijk dit expliciet op te nemen in het EG-verdrag. And, at this point, we have yet another classic debate, the one which concerns the legal basis: is this a matter to do with the market, in which case Article 95 of the Treaty establishing the European Community applies, or the rules of operation or indeed health policy? The matter has been referred to the Court of Justice of the European Communities.

The provisions of this Agreement that fall within the scope of Part III, Title IV, of the Treaty establishing the European Community bind the United Kingdom and Ireland as separate Contracting Parties, and not as part of the European Community, until the United Kingdom or Ireland (as the case may be) notifies Chile that it has become bound as part of the European Community in accordance with the Protocol on the position of the United Kingdom and Ireland annexed to the Treaty on European Union and the Treaty establishing the European Community.
