In order to ensure that this Directive is fully operational and to adapt it to technical, scientific and international developments in tobacco manufacture, consumption and regulation, the power to adopt acts in accordance with Article 290 TFEU should be delegated to the Commission in respect of adopting and adapting maximum emission levels and methods for measuring those emissions, setting maximum levels for additives that result in a characterising flavour or that increase toxicity or addictiveness, withdrawing certain exemptions granted to tobacco products other than cigarettes and roll-your-own tobacco, adapting the health warnings, establishing and adapting the picture library, defining the key elements of the data storage contracts to be concluded for the purposes of the tracking and tracing system, and extending measures adopted by Member States to the entire Union concerning specific electronic cigarettes or refill containers or a type of electronic cigarette or refill container.
Om ervoor te zorgen dat de richtlijn volledig operationeel wordt en om haar aan te passen aan de technische, wetenschappelijke en internationale ontwikkelingen in de tabaksproductie, -consumptie en -regulering moet aan de Commissie de bevoegdheid worden overgedragen om overeenkomstig artikel 290 VWEU handelingen vast te stellen ten aanzien van de vaststelling en aanpassing van maximumemissieniveaus en de methoden voor het meten van die emissies, de vaststelling van maximumniveaus voor additieven die een kenmerkend aroma produceren of die de toxiciteit of de verslavende werking vergroten, het intrekken van bepaalde vrijstellingen voor andere tabaksproducten dan sigaretten en shagtabak, de aanpassing van de gezondheidswaarschuwingen, de vaststelling en aanpassing van de beeldbank, de herziening, de omschrijving van de belangrijkste elementen van de gegevensopslagovereenkomsten die moeten worden gesloten ten behoeve van het volg- en traceersysteem, en het uitbreiden tot de gehele Unie van de maatregelen van de lidstaten betreffende specifieke elektronische sigaretten of navulverpakkingen, dan wel een type daarvan.

(2) For documents for which libraries (including university libraries), museums and archives have intellectual property rights, Member States shall ensure that, where the re-use of documents is allowed, these documents shall be re-usable for commercial or non-commercial purposes in accordance with the conditions set out in Chapters III and IV, provided that the documents concerned are of types classified as accessible under the rules which exist in the Member States regarding access to public-sector information.

(10) The scope of application of the Directive is extended to libraries (including university libraries), museums and archives, encouraging the use of virtualisation of historical sites in order to simplify access to this type of information.
