The real significance of this approach, though, lies in the remit of the European Convention itself, which is to lay down the constitutional foundations of the European Union, in line with the message which the Commission spelt out in its "project for the European Union".

Where the Commission finds, within six months after receiving the annual assessment report of the national supervisory authority concerned, that the assessment report does not establish that the variation of actual costs against determined costs is actually the result of relevant events or circumstances set out in paragraph 2(a) and in line with the provision of paragraph 2(b), it shall decide in accordance with the procedure referred to in Article 5(2) of Regulation (EC) No 549/2004 that the Member State(s) concerned shall not be allowed to apply the provisions of paragraph 2 in respect to the variation of actual costs against determined costs, in part or in whole according to its findings.

The national supervisory authority concerned shall establish each year that the variation of actual costs against determined costs is actually the result of relevant events or circumstances set out in paragraph 2(a) and in line with the provision of paragraph 2(b).

(12a) The activities related to the decommissioning of the Kozloduy Nuclear Power Plant will be carried out in line with the fundamental objective of protecting workers and the general public from the harmful effects of ionising radiation, as laid down in existing legislation, particularly Council Directive 96/29/Euratom of 13 May 1996 laying down basic safety standards for the protection of the health of workers and the general public against the dangers arising from ionizing radiation 1 , thus ensuring the highest level of safety and protection for workers and the general public's health.
(12 bis) Bij de werkzaamheden in verband met de buitenbedrijfstelling van de kerncentrale van Kozloduy zal de bescherming van de werknemers en het publiek tegen de schadelijke gevolgen van ioniserende straling vooropstaan, zoals deze wordt voorgeschreven in de bestaande wetgeving, in het bijzonder in Richtlijn 96/29/Euratom van de Raad van 13 mei 1996 tot vaststelling van de basisnormen voor de bescherming van de gezondheid der bevolking en der werkers tegen de aan ioniserende straling verbonden gevaren 1 , zodat het hoogste niveau van veiligheid en bescherming van de werknemers en de volksgezondheid wordt gewaarborgd.

Consequently, Directive 86/609/EEC should be amended to include the Regulatory Committee Procedure (as foreseen in Council Decision 1999/468/EC laying down the procedures for the exercise of implementing powers conferred on the Commission) and provide for a simplified procedure as regards adaptation of annex 2 of the Directive to technical progress without which the Community's implementing legislation will be out of line with the Convention.
