The award of contracts concluded in the Member States by contracting entities as referred to in Directive 2004/17/EC of the European Parliament and of the Council of 31 March 2004 coordinating the procurement procedures of entities operating in the water, energy, transport and postal services sectors and by contracting authorities as referred to in Directive 2004/18/EC of the European Parliament and of the Council of 31 March 2004 on the coordination of procedures for the award of public works contracts, public supply contracts and public service contracts is subject to compliance with the principles of the Treaty and in particular the free movement of goods, the freedom of establishment and the freedom to provide services, and with the principles deriving therefrom, such as the principles of equal treatment, non-discrimination, mutual recognition, proportionality and transparency.

(28) Taking into account the further opening up of Community postal services to competition and the fact that such services are provided through a network by contracting authorities, public undertakings and other undertakings, contracts awarded by contracting entities providing postal services should be subject to the rules of this Directive, including those in Article 30, which, safeguarding the application of the principles referred to in recital 9, create a framework for sound commercial practice and allow greater flexibility than is offered by Directive 2004/18/EC of the European Parliament and of the Council of 31 March 2004 on the coordination of procedures for the award of public works contracts, public supply contracts and public service contracts(11).
(28) In verband met de voortschrijdende openstelling van de postdiensten van de Gemeenschap voor mededinging en het feit dat deze diensten zowel door aanbestedende diensten, overheidsbedrijven als andere ondernemingen via een netwerk worden geleverd, is het dienstig te bepalen dat opdrachten geplaatst door aanbestedende diensten die postdiensten aanbieden, onderworpen zijn aan de voorschriften van de onderhavige richtlijn, inclusief die van artikel 30, welke de toepassing van de in overweging 9 bedoelde beginselen vrijwaren en tegelijkertijd een kader voor loyale handelspraktijken scheppen en een grotere flexibiliteit verschaffen dan mogelijk is op grond van het bepaalde in Richtlijn 2004/18/EG van het Europees Parlement en de Raad van31 maart 2004(11).
