Under Article 15 of Regulation (EC) No 318/2006, a surplus amount is to be levied on quantities of surplus sugar, surplus isoglucose and surplus inulin syrup not carried forward or exported, or used for the specific supply arrangements for the outermost regions, and on industrial sugar, industrial isoglucose and industrial inulin syrup for which no proof has been supplied, by a date to be determined, that it has been processed into one of the products referred to in Article 13(2) of that Regulation; and on quantities withdrawn from the market in accordance with Article 19 of that Regulation and for which the obligations provided for in Article 19(3) thereof are not met.

Notes that each year the EU budget shows a surplus and that the Member States’ contributions to the EU budget are lowered by this amount; at the same time deplores the Council’s regular linear cuts to the Commission’s estimations for payment appropriations, as entered in the draft budget, as well as the Council’s repeated objection, over the last years, to providing the EU budget with the level of additional payments needed by the Commission, at the end of the budgetary year, to enable the EU to meet its financial commitments; is of the opinion that such an approach is not good budgeting, and that, while the returned surplus has no impact on the overall deficit level of Member States, this amount could make a clear difference to the EU’s annual budget; recalls the commitment made by the institutions to revise the Financial Regulation in order to allow the carry-over of unused appropriations and of the budgetary balance;

The reason for this surplus is that all operations carried out for the benefit of a third country or for the purpose of financing projects in a third country shall fall outside the scope of Council Regulation (EC, Euratom) No 2728/94 of 31 October 1994 establishing a Guarantee Fund for external actions, with effect from the date on which that country accedes to the EU. The above amount results from the repayment to the general budget of the amount corresponding to the provision of outstanding capital liabilities for Bulgaria and Romania at 1 January 2007.

For the quantities of sugar beet corresponding to the quantities of industrial sugar or surplus sugar that are subject to the surplus amount provided for in Article 15, the sugar undertaking concerned shall adjust the purchase price so that it is at least equal to the minimum price for quota beet.

Voor de hoeveelheden suikerbieten die overeenstemmen met de hoeveelheden industriële suiker of overtollige suiker waarvoor de in artikel 15 bedoelde overschotheffing wordt opgelegd, past de betrokken suikerproducerende onderneming de aankoopprijs op zodanige wijze aan dat deze ten minste gelijk is aan de minimumprijs voor quotumbieten.

3. Consequently, the Commission states that it will be unable to pay in 2003 all payment claims received, i.e. an expected amount of € 4.108 billion at the end of 2003, leading to a estimated surplus of € 5.476 billion. As a result, the Commission is now proposing to reduce the 2003 budget by € 5 billion, which, in concrete terms, means that Member States contribution to the EU budget will be reduced by the same amount.
3. De Commissie stelt dan ook dat zij in 2003 niet zal kunnen voldoen aan alle ingediende betalingsverzoeken, te weten een geraamd bedrag van € 4 108 miljard tegen het einde van 2003, waardoor een geraamd overschot van € 5 miljard zal ontstaan, hetgeen in concrete termen betekent dat de bijdrage van de lidstaten aan de begroting van de EU met eenzelfde bedrag zal worden verminderd.
