Position: Take note of the Secretary General's report, provide some information on relevant on-going activities and developments, encourage further work on the assessment of interfaces between customs and rail transport regulations, and support the establishment of a working group of legal experts, or alternative coordination arrangements within existing OTIF bodies, concerning customs issues and the digitalisation of freight transport documents.

This Communication is a further consultative document aimed at gathering views and comments. The reactions are important for the Commission in order to know all relevant arguments and assessments before proposing the most appropriate provisions for a New Legal Framework.

2. Where administrative controls reveal inconsistencies or irregularities, the Responsible Authority shall carry out detailed checks in order to assess the legality and regularity of the expenditure, in particular by reviewing a targeted sample of supporting documents.

To cite a few examples, based on the joint assessment of situations in countries of origin, of certain types of cases or of certain aspects of asylum applications that require specific legal or factual expertise, Member States could adopt common approaches to exclusion or cessation clauses with regard to certain caseloads, to concepts such as gender- or child-specific persecution, to the detection and prevention of fraud or abuse, or to the translation of documents and the methods and procedures for interviews.

(4) In order to ensure uniform conditions for the implementation of Regulation (EC) No 2173/2005, implementing powers should be conferred on the Commission to assess and approve existing schemes that guarantee the legality and reliable tracking of timber products exported from partner countries with a view to becoming the basis of a Forest Law Enforcement, Governance and Trade (FLEGT) licence, and to adopt modalities of a practical nature and documents of a standard format, including their possible means (electronic or paper format) in relation to the FLEGT licensing scheme . Those powers should be exercised in accordance with Regulation (EU) No 182/2011 of the European Parliament and of the Council .
(4) Om eenvormige voorwaarden te waarborgen voor de uitvoering van Verordening (EG) nr. 2173/2005, moeten aan de Commissie uitvoeringsbevoegdheden worden toegekend om bestaande systemen die de legaliteit en de betrouwbare traceerbaarheid van uit partnerlanden ingevoerde houtproducten waarborgen, te beoordelen en goed te keuren, teneinde als uitgangspunt te dienen voor een vergunning op basis van het kader inzake „Wetshandshandhaving, governance en handel in de bosbouw” (Forest Law Enforcement, Governance and Trade – FLEGT) (hierna: FLEGT-vergunning), en om praktische procedureregelingen en standaarddocumenten vast te stellen, met inbegrip van de mogelijke (elektronische of papieren) media hiervoor, met betrekking tot het FLEGT-vergunningensysteem. Recalls that, before assessing whether or not the exception of Article 4(2), second indent on the protection of legal advice applies, the institution concerned must satisfy itself that the document it is asked to disclose does indeed relate to legal advice and, if so, must decide which parts of it are actually concerned and may therefore be covered by the exception (Turco , paragraph 38);

Recalls that transparency as required by the Treaties is not limited to legislative procedures but also covers the non-legislative work of EU institutions, bodies, offices and agencies; stresses that Regulation (EC) No 1049/2001 is the only proper legal basis for assessing the right of access to documents, and that other legal acts, such as internal or founding regulations of institutions, agencies and bodies, cannot introduce additional grounds for refusing access;

Despite the fact that this document has no formal legal status (binding nature), it has been widely used including in the context of proceedings before the ECJ,[25] as well as by national courts and authorities in their assessment of individual cases.
