1. 22. If an ascending clock auction has not ended by the scheduled starting point (according to the auction calendar) of the next auction for capacity covering the same period, the first auction shall close and no capacity shall be allocated.

In view of legal certainty and transparency, this Regulation should contain detailed provisions on other aspects of auctioning such as lot size, the possibility to withdraw or modify submitted bids, the currency used for bidding and for payment, the submission and processing of applications for admission to bid, as well as any refusal, revocation or suspension of admission.
Met het oog op de rechtszekerheid en de transparantie dient deze verordening nadere bepalingen te bevatten over andere aspecten van de veilingen, zoals de grootte van de kavels, de mogelijkheid om reeds uitgebrachte biedingen in te trekken of te wijzigen, de voor biedingen en betalingen gebruikte valuta, de indiening en behandeling van aanvragen om toelating om te bieden alsook de weigering, herroeping of schorsing van die toelating.

4. A Member State not participating in the joint action as provided in Article 26(1) and (2) of this Regulation but opting to appoint its own auction platform pursuant to Article 30(1) and (2) of this Regulation may request the auction monitor to provide the Member States, the Commission and the auction platform concerned with a technical report on the ability of the auction platform it proposes or intends to propose, to carry out the auction process in accordance with the requirements of this Regulation and in conformity with the objectives set out in Article 10(4) of Directive 2003/87/EC.

Een lidstaat die niet deelneemt aan de gezamenlijke actie als bedoeld in artikel 26, leden 1 en 2, maar ervoor kiest zijn eigen veilingplatform aan te wijzen overeenkomstig artikel 30, leden 1 en 2, kan de veilingtoezichthouder verzoeken de lidstaten, de Commissie en het betrokken veilingplatform een technisch verslag te verstrekken over de geschiktheid van het veilingplatform dat hij voorstelt of voornemens is voor te stellen, om het veilingproces uit te voeren overeenkomstig de vereisten van deze verordening en de doelstellingen van artikel 10, lid 4, van Richtlijn 2003/87/EG.

4. Een lidstaat die niet deelneemt aan de in artikel 26 bedoelde gezamenlijke actie maar ervoor kiest om zijn eigen veilingplatform aan te wijzen overeenkomstig artikel 30, leden 1 en 2, kan de veilingtoezichthouder verzoeken om de lidstaten, de Commissie en het betrokken veilingplatform een technisch verslag te doen toekomen over het vermogen van het door hem voorgestelde of voor te stellen veilingplatform om het veilingproces uit te voeren overeenkomstig de eisen van deze verordening en conform de in artikel 10, lid 4, van Richtlijn 2003/87/EG vermelde doelstellingen.

The auction platforms appointed pursuant to Article 30(1) or (2) shall determine and publish as provided for in the first subparagraph of this paragraph in accordance with the volumes attributed to the Member State appointing the auction platform concerned as set out in Annex I and the Commission’s latest determination and publication of the estimated number of allowances to be auctioned referred to in Article 10(1) of Directive 2003/87/EC, taking into account to the extent possible any transitional free allocations deducted or to be deducted from the quantity of allowances that a given Member State would otherwise auction pursuant to Article 10(2) of Directive 2003/87/EC as provided for in Article 10c(2) of that Directive.
