– having regard to the opinion of the Belgian Committee on Privacy concerning two cases involving the transfer by three airlines of the personal data relating to certain transatlantic passengers (including those relating to an MEP), an opinion in which it is stated that both Belgian and EU privacy laws have been infringed; having regard to the Council's observation that "the US measures potentially conflict with Community and Member States" legislation on data protection" (2562nd meeting of the General Affairs Council held in Brussels on 23 February 2004); having regard to the internal Commission document which confirms that such a conflict does indeed exist; whereas Parliament has condemned the blatant violation of privacy laws, and whereas major responsibilities lie with the Commission, the Member States and certain authorities whose task is to safeguard privacy,
– gezien het advies van de Belgische privacycommissie inzake twee gevallen van doorgave door drie luchtvaartmaatschappijen van de persoonsgegevens van enkele transatlantische passagiers - onder meer de gegevens van een EP-lid - waaruit blijkt dat het nationale en Europese privacyrecht geschonden is; gezien de vaststelling van de Raad dat "de maatregelen van de VS potentieel strijdig zijn met de communautaire wetgeving en de wetgevingen van de lidstaten inzake de bescherming van persoonsgegevens (2562e zitting van de Raad Algemene Zaken van 23 februari 2004 in Brussel); gezien het interne document van de Commissie dat deze strijdigheid bevestigt; overwegende dat het EP de flagrante schending van de privacywetgeving aan de kaak heeft gesteld en heeft gewezen op de zware verantwoordelijkheid ter zake van de Commissie, de lidstaten en enkele instanties die tot taak hebben de privacy te garanderen,

60. Shares the view of the Working Party on Privacy regarding the inadequacy of the rules on privacy in the United States, and the view of the Belgian Commission on Privacy regarding the violation of national and Community law when the personal data of passengers on transatlantic flights are transferred to the United States; calls on the Commission and the privacy protection authorities to take all the necessary measures to put an end to the present illegal situation by enforcing Community and national privacy laws;
60. deelt de mening van werkgroep persoonlijke levenssfeer over het ontoereikende karakter van de regelgeving betreffende de persoonlijke levenssfeer in de Verenigde Staten en die van de Belgische commissie persoonlijke levenssfeer ten aanzien van de schending van het nationaal en communautair recht naar aanleiding van de overdracht van persoonsgegevens door luchtvaartmaatschappijen bij transatlantische vluchten naar de Verenigde Staten; verzoekt de Commissie alsmede de autoriteiten, met het oog op de bescherming van de persoonlijke levenssfeer, alles in het werk te stellen om een einde te maken aan deze illegale situatie en de communautaire en nationale wetgeving inzake de persoonlijke levenssfeer te doen naleven;

– having regard to the documents relating to the transfer of transatlantic passengers' personal data to the USA, with particular reference to: the opinions of the Article 29 Working Party, the Commission communications, the US Undertakings, the opinion of the Belgian Committee on the Protection of Privacy on complaints by some passengers, and the complaint lodged with the Commission regarding the violation of Council Regulation (EEC) No 2299/89 of 24 July 1989 on a code of conduct for computerized reservation systems ,
– gezien de documenten betreffende de overdracht van persoonsgegevens van transatlantische passagiers naar de VS, inzonderheid de adviezen van de werkgroep "artikel 29", de mededelingen van de Commissie, de "Undertakings" van de VS, het advies van de Belgische Commissie voor de bescherming van persoonsgegevens naar aanleiding van klachten van enkele passagiers, de klacht ingediend bij de Commissie wegens overtreding van Verordening (EEG) nr. 2299/89 van de Raad van 24 juli 1989 betreffende gedragsregels voor geautomatiseerde boekingssystemen ,
