On examining the proposal for a directive of the European Parliament and of the Council intended to codify the initial Council directive, of 9 March 1968, on coordination of safeguards which, for the protection of members and others, are required by Member States of companies within the meaning of the second paragraph of Article 58 of the Treaty, with a view to making such safeguards equivalent throughout the Community, an act which has been substantially amended several times, the working party noted, by common accord, that the wording of Article 15 should be adjusted to read as follows: ‘The Commission shall present to the European Parliament and to the Council, by 1 January 2012, a report, together, if appropriate, with a proposal amending the provisions of Article 2(f) and Articles 3, 4, 5, and 7 in the light of the experience acquired in applying this Directive, of its aims and of the technological developments observed at the time’.

Action proposed by the Commission: Entitle the Community to act unilaterally in order to identify and establish black lists of states hosting flags of non compliance and vessels responsible for IUU fishing, and enact trade measures towards them.

In view of the particular weight in the general budget of the European Communities of the resource referred to in Article 2(1)(c) of Council Decision 2007/436/EC, Euratom of 7 June 2007 on the system of the European Communities' own resources (5), it is appropriate to continue to provide, exceptionally, for the Council, acting by qualified majority on a proposal from the Commission, to adopt the necessary decision concerning the amount of Community support for rural development for the period from 1 January 2007 to 31 December 2013, its annual breakdown and the minimum amount to be concentrated in regions eligible under the Convergence Objective.
Aangezien het eigen middel, bedoeld in artikel 2, lid 1, onder c), van Besluit 2007/436/EG, Euratom van de Raad van 7 juni 2007 betreffende het stelsel van eigen middelen van de Europese Gemeenschappen (5), in de algemene begroting van de Europese Gemeenschappen een bijzonder gewicht heeft, is het passend er bij wijze van uitzondering in te blijven voorzien dat de Raad, met gekwalificeerde meerderheid en op voorstel van de Commissie, het noodzakelijke besluit aanneemt tot vaststelling van het bedrag van de steun van de Gemeenschap voor plattelandsontwikkeling voor de periode van 1 januari 2007 tot en met 31 december 2013, van de verdeling daarvan over de jaren en van het minimumbedrag dat moet worden geconcentreerd in de onder de convergentiedoelstelling vallende regio’s.

(23) After careful examination of the "Amendment of export visa and quota requirements for certain textile products produced and manufactured in all countries and made up in the European Community" and section 405 of the Trade and Development Act of 2000, and after consultations with the complainant, who expressed his satisfaction, the European Commission concluded that section 405 of the Trade and Development Act of 2000 was in conformity with the US commitments under the procès-verbal of 16 August 1999 and effectively removed the obstacles to trade addressed in Federtessile's complaint of 11 October 1996.

Due to the need to comply with international agreements, the Commission should be empowered to modify the technical procedures for the calculation methods concerning thresholds as well as to periodically revise the thresholds themselves; references to the CPV nomenclature may undergo regulatory changes at Union level and it is necessary to reflect those changes into the text of this Directive; the technical details and characteristics of the devices for electronic receipt should be kept up to date with technological developments; it is also necessary to empower the Commission to make mandatory certain technical standards for electronic communication to ensure the interoperability of technical formats, processes and messaging in procurement procedures conducted using electronic means of communication taking into account technological developments; the Commission should also be empowered to adapt the list of legislative acts of the Union establishing common methodologies for the calculation of life-cycle costs; the list of International Social and Environmental Conventions and the list of Union legislation whose implementation creates a presumption of free access to a given market as well as Annex II„ setting out a list of legal acts to be taken into account when assessing the existence of special or exclusive rights, should be quickly adapted to incorporate the measures adopted on a sectoral basis.
Wegens de verplichting tot nakoming van internationale overeenkomsten moet de Commissie de bevoegdheid krijgen om de technische procedures voor de berekeningsmethoden van de drempels te wijzigen alsmede om de drempels zelf regelmatig te herzien; verwijzingen naar de CPV-nomenclatuur kunnen door regelgeving van de Unie worden gewijzigd, en moeten als zodanig in de tekst van de richtlijn worden verwerkt; de technische details en kenmerken van de middelen voor elektronische ontvangst moeten worden aangepast aan de technologische ontwikkelingen: de Commissie moet eveneens de bevoegdheid krijgen om een aantal technische normen voor elektronische communicatie verplicht te stellen teneinde, rekening houdend met technologische ontwikkelingen, de interoperabiliteit van technische formaten, processen en kennisgevingen te verzekeren in aanbestedingsprocedures waar gebruik wordt gemaakt van elektronische communicatie; de Commissie moet voorts de bevoegdheid krijgen om de lijst van wetgevingshandelingen van de Unie tot invoering van gemeenschappelijke methoden voor de berekening van levenscycluskosten aan te passen; de lijst van internationale sociale en milieuovereenkomsten en de lijst van Uniewetgeving waarvan de tenuitvoerlegging het vermoeden van vrije toegang tot een bepaalde markt vormt, alsmede bijlage II, die een opsomming geeft van de bij de beoordeling van het bestaan van bijzondere of uitsluitende rechten in aanmerking te nemen rechtshandelingen, moeten snel worden aangepast om de op sectorale basis vastgestelde maatregelen daarin op te nemen.
