This entails that, for stays not exceeding three months, the conditions for admission of seasonal workers to the territory of the Member States applying the Schengen acquis in full are regulated by those instruments, while the present Directive should only regulate the criteria and requirements for access to employment. In the case of Member States not applying the Schengen acquis in full, with the exception of the United Kingdom and Ireland, only the Schengen Borders Code applies.
Voor een verblijf van minder dan 90 dagen worden de voorwaarden voor de toelating van seizoenarbeiders op het grondgebied van de lidstaten die het Schengenacquis volledig toepassen derhalve geregeld door deze instrumenten; deze richtlijn heeft alleen betrekking op de criteria en de voorwaarden voor de toegang tot arbeid. The precondition for association with the Schengen acquis by non-EU countries is an agreement on free movement of persons between those states and the EU. For these countries, this participation involves the following: being included in the area without checks at internal borders; applying the provisions of the Schengen acquis and of all Schengen-relevant texts adopted pursuant to it; being involved in decisions relating to Schengen-relevant texts.
Een belangrijke voorwaarde voor niet-EU-landen om bij het Schengenacquis te mogen aansluiten is een overeenkomst over het vrij verkeer van personen tussen deze landen en de EU. This legal basis was chosen as the correct one for the current Schengen evaluation mechanism when the Schengen acquis was integrated into the European Union framework by the ‘breakdown’ decision taken in 1999.

(6d) This Regulation constitutes a development of provisions of the Schengen acquis in which the United Kingdom does not take part, in accordance with Council Decision 2000/365/EC of 29 May 2000 concerning the request of the United Kingdom of Great Britain and Northern Ireland to take part in some of the provisions of the Schengen acquis. The United Kingdom is therefore not taking part in its adoption and is not bound by it or subject to its application.
(6 quinquies) Deze verordening vormt een ontwikkeling van bepalingen van het Schengenacquis waaraan het Verenigd Koninkrijk niet deelneemt, overeenkomstig Besluit 2000/365/EG van de Raad van 29 mei 2000 betreffende het verzoek van het Verenigd Koninkrijk van Groot-Brittannië en Noord-Ierland deel te mogen nemen aan enkele van de bepalingen van het Schengenacquis, en daaropvolgend Besluit 2004/926/EG van de Raad van 22 december 2004 betreffende de toepassing door het Verenigd Koninkrijk van Groot-Brittannië en Noord-Ierland van de bepalingen van het Schengenacquis.

In accordance with the second subparagraph of Article 3(2) of the 2003 Act of Accession and as a result of the partial application of the Schengen acquis by the United Kingdom of Great Britain and Northern Ireland provided for in Council Decision 2004/926/EC of 22 December 2004 on the putting into effect of parts of the Schengen acquis by the United Kingdom of Great Britain and Northern Ireland (5), and in particular the first subparagraph of Article 1 thereof, only part of the provisions of the Schengen acquis applicable to the Member States concerned in their relations with Member States applying the Schengen acquis in full should apply in the relations of the Member States concerned with the United Kingdom of Great Britain and Northern Ireland.
Overeenkomstig artikel 3, lid 2, tweede alinea, van de Toetredingsakte van 2003 en als gevolg van de gedeeltelijke toepassing van het Schengenacquis door het Verenigd Koninkrijk van Groot-Brittannië en Noord-Ierland overeenkomstig Besluit 2004/926/EG van de Raad van 22 december 2004 betreffende de toepassing door het Verenigd Koninkrijk van Groot-Brittannië en Noord-Ierland van delen van het Schengenacquis (2004/926/EG) (5), inzonderheid artikel 1, eerste alinea, dient in de betrekkingen van de betrokken lidstaten met het Verenigd Koninkrijk van Groot-Brittannië en Noord-Ierland slechts een gedeelte te worden toegepast van het Schengenacquis dat geldt voor de betrekkingen van de betrokken lidstaten met de lidstaten die het Schengenacquis volledig toepassen.

The Council has now verified, in accordance with the applicable Schengen evaluation procedures as set out in the Decision of the Executive Committee of 16 September 1998 setting up a Standing Committee on the evaluation and implementation of Schengen (SCH/Com-ex (98) 26 def.) (2), that the necessary conditions for the application of the Schengen acquis have been met in all other areas of the Schengen acquis — Air Borders, Land Borders, Police Cooperation, the Schengen Information System, Sea Borders and Visas — in the Member States concerned.
De Raad heeft thans overeenkomstig de toepasselijke Schengenevaluatieprocedures in de versie van het besluit van het Uitvoerend Comité van 16 september 1998 betreffende de oprichting van een permanente Schengencommissie (SCH/Com-ex (98) 26 def.) (2), vastgesteld dat op alle overige terreinen van het Schengenacquis (lucht- en landgrenzen, politiële samenwerking, het Schengeninformatiesysteem, zeegrenzen en visa) door de betrokken lidstaten aan de nodige voorwaarden wordt voldaan.

(5) This instrument constitutes a development of the Schengen acquis, in accordance with the Protocol integrating the Schengen acquis into the framework of the European Union, as defined in Annex A to Council Decision 1999/435/EC concerning the definition of the Schengen acquis for the purpose of determining, in conformity with the relevant provisions of the Treaty establishing the European Community and the Treaty on European Union, the legal basis for each of the provisions or decisions which constitute the acquis(4).
(5) Met de onderhavige verordening wordt, overeenkomstig het protocol tot opneming van het Schengenacquis in het kader van de Europese Unie, voortgebouwd op het Schengenacquis als omschreven in bijlage A van Besluit 1999/435/EG van de Raad van 20 mei 1999 tot vaststelling in overeenstemming met de desbetreffende bepalingen van het Verdrag tot oprichting van de Europese Gemeenschap en het Verdrag betreffende de Europese Unie, van de rechtsgrondslag van elk van de bepalingen of besluiten die het Schengenacquis vormen(4).
