TRADUCTIONS EN CONTEXTE

1. The CDE Statutes, the CDE Financial Regulation and the CDE Staff Regulation shall remain in force until the end of the closure phase.

Under point (a) of Article 2(6) of that Annex III, the ACP-EU Committee of Ambassadors is appointed as the supervisory authority of the CDE with, amongst other things, the responsibility to lay down the statutes of the CDE, which were adopted by Decision No 8/2005 of the ACP-EC Committee of Ambassadors (‘CDE Statutes’).
Op grond van artikel 2, lid 6, onder a), van die bijlage III, wordt het ACS-EU-Comité van ambassadeurs aangewezen als toezichthoudende autoriteit van het COB en onder meer gemachtigd de statuten van het COB vast te stellen, hetgeen is gebeurd bij Besluit nr. 8/2005 van het ACS-EG-Comité van ambassadeurs („COB-statuten”).

Under Article 26(1) of the CDE Financial Regulation, adopted by Decision No 5/2004 of the ACP-EC Committee of Ambassadors , the CDE's accounts should be closed at the end of the financial year in order to draw-up the CDE's financial statements.

2. As from 1 January 2017 the legal personality of the CDE, as defined in Article 1 of the CDE Statutes, shall be maintained solely for the purposes of the liquidation of the CDE.

Under point (a) of Article 2(7) of Annex III the CDE Executive Board is made, amongst other things, responsible for adopting the CDE's financial regulation and staff regulation.

The CDE's Statutes and Rules of Procedure adopted by Decision No 8/2005 of the ACP-EC Committee of Ambassadors (the ‘CDE Statutes’) and the CDE's Financial Regulation adopted by Decision No 5/2004 of the ACP-EC Committee of Ambassadors (the ‘CDE Financial Regulation’), provide the safeguards in terms of information of and supervision by the ACP-EU Committee of Ambassadors.

1. In line with the procedures laid down in the ACP-EU Partnership Agreement, the CDE Statutes and the CDE Financial Regulation, the ACP-EU Committee of Ambassadors shall receive the closure plan adopted by the Executive Board of the CDE.

The Executive Board of the CDE shall supervise the work of the CDE (Article 2(7)(b)), adopt the programme and the budget of the CDE (Article 2(7)(c)) and submit periodic reporting and evaluations to the ACP-EU Committee of Ambassadors (Article 2(7)(d)).
De raad van bestuur van het COB houdt toezicht op de werkzaamheden van het COB (artikel 2, lid 7, onder b)), stelt het programma en de begroting van het COB vast (artikel 2, lid 7, onder c)), en dient periodieke verslagen en evaluaties in bij het ACS-EU-Comité van ambassadeurs (artikel 2, lid 7, onder d)).

1. Subject to the conditions laid down in Articles 2, 3 and 4 of this Decision, the ACP-EU Committee of Ambassadors hereby authorises the Executive Board of the CDE to take, with immediate effect, all appropriate measures to prepare for the closure of the CDE.
1. Onder de voorwaarden van de artikelen 2, 3 en 4 van dit besluit machtigt het ACS-EU-Comité van ambassadeurs de raad van bestuur van het COB om, met onmiddellijke ingang, alle passende maatregelen voor de voorbereiding van de sluiting van het COB te nemen.

Article 2(6)(d) of Annex III to the ACP-EU Partnership Agreement requires the ACP-EU Committee of Ambassadors to monitor the overall strategy of the CDE and to supervise the work of the Executive Board of the CDE.
Op grond van bijlage III, artikel 2, lid 6, onder d), van de ACS-EU-partnerschapsovereenkomst moet het ACS-EU-Comité van ambassadeurs toezicht houden op de algemene strategie van het COB en heeft het de supervisie over de werkzaamheden van de raad van bestuur van het COB.
