TRADUCTIONS EN CONTEXTE

This 2nd progress report is being issued according to Article 17 of the Directive which calls for the Commission to periodically report on the operation of the Directive and cover inter alia progress on drawing up the relevant standards as well as any problems that have arisen in the course of implementation.

Overall progress has to be assessed in the context of a wider social recognition of key principles such as the rule of law, and the independence of the judicial process as part of the checks and balances of a well-functioning democracy.

"As regards pilots involved in the operation of aircraft referred to in Article 4(1)(b) and (c), as well as flight simulation training devices, persons and organisations involved in the training, testing, checking or medical assessment of these pilots, the Commission shall be empowered, by means of delegated acts in accordance with Article 65b, to amend or supplement Annex III, where necessary for reasons of technical, operational or scientific developments or safety evidence related to the pilot licencing, in order to, and to the extent needed to, achieve the objectives laid down in Article 2".

To this end, border surveillance is not limited to the detection of attempts at unauthorised border crossings but equally extends to steps such as intercepting vessels suspected of trying to gain entry to the Union without submitting to border checks, as well as arrangements intended to address situations such as search and rescue that may arise during a border surveillance operation at sea and arrangements intended to bring such an operation to a successful conclusion.

C. Whereas problems have however arisen in its operation, some specific to Framework Decision 2002/584/JHA and resulting from gaps in the Framework Decision such as failing to explicitly include fundamental rights safeguards or a proportionality check as well as from the incomplete and inconsistent implementation thereof; whereas other problems are shared with the set of mutual recognition instruments due to the incomplete and unbalanced development of the Union area of criminal justice;
C. overwegende dat tijdens de toepassing ervan echter problemen zijn opgetreden, waarvan sommige specifiek voor Kaderbesluit 2002/584/JBZ en het gevolg van hiaten in het Kaderbesluit zijn, zoals het ontbreken van een expliciete verwijzing naar waarborgen van de grondrechten of een evenredigheidscontrole, alsook het gevolg van een onvolledige en inconsequente tenuitvoerlegging ervan; overwegende dat andere problemen ook voorkomen bij de reeks instrumenten voor wederzijdse erkenning vanwege de onvolledige en onevenwichtige ontwikkeling van de strafrechtelijke ruimte van de Unie;

25. Calls on the Commission to set out in that regulation specific European certification criteria and general basic rules for the various product categories, with which every aquaculture establishment in the Community must comply, together with provisions for maximum harmonisation of environmental impact criteria at Community level in order to avoid any distortion of competition between Member States, but to delegate responsibility for the implementation phase and checks on the operation of the establishments to the competent authorities of the Member States, in full accordance with the principle of subsidiarity; e.g. parameters on environmental impact, use of water resources, feeding of farmed fish, molluscs and crustaceans in production units, product traceability and labelling, as well as fish health and welfare standards etc.;
25. verzoekt de Commissie in deze verordening specifieke Europese certificeringscriteria en algemene basisnormen voor de verschillende soorten producten vast te stellen, die alle communautaire aquacultuurbedrijven moeten naleven, tezamen met bepalingen voor een maximale harmonisatie van criteria op communautair niveau voor milieueffecten, ter voorkoming van concurrentieverstoring tussen de lidstaten, en, overeenkomstig het subsidiariteitsbeginsel, de uitvoering en de controle op de exploitatie van de bedrijven te delegeren aan de bevoegde autoriteiten in de lidstaten: bijvoorbeeld parameters voor het milieueffect, het gebruik van de watervoorraden, de voedering van de gekweekte vissen, schelpdieren en schaaldieren in productie-eenheden, de traceerbaarheid en de etikettering van het product, de gezondheid en het welzijn van de vissen, enz.;

To ensure the cost-effectiveness of such checks, eligibility to apply for admission to the auctions should be given to easily identifiable, well-defined categories of participants, notably operators of stationary installations and aircraft operators covered by the emissions trading scheme, as well as regulated financial entities such as investment firms and credit institutions.
