Whereas, pursuant to Regulation (EEC) No 2828/93, as amended by Regulation (EC) No 2206/94 (5), the physical and chemical characteristics of certain oils are such as to preclude any confusion with olive oil, and as result those oils are excluded from the scope of that Regulation; whereas, given that there has never been any risk that those particular oils might improperly be diverted to other uses, the securities lodged for the quantities placed in free circulation before the entry into force of Regulation (EC) No 2206/94 should be released without presentation of a T 5 control copy;

Member States of the Community, as constituted at 31 December 1985, in which olive oil originating in Tunisia is released for free circulation in accordance with Regulation (EEC) No 3159/87 shall introduce a control system which requires that, in cases where olive oil which falls within subheadings 15.07 A I a) and b) of the Common Customs Tariff and which is contained in vessels of a net capacity greater than five litres, or in bulk, is exported to Spain or to Portugal from the territory of those Member States, the operator must demonstrate to the satisfaction of those Member States that the oil concerned is not of Tunisian origin. That requirement shall apply until 31 August 1988, without prejudice to application of paragraph 2.

De Lid-Staten van de Gemeenschap in haar samenstelling op 31 december 1985 waarin uit Tunesië afkomstige olijfolie in het vrije verkeer wordt gebracht op de voorwaarden bedoeld in Verordening (EEG) nr. 3159/87, stellen een controlesysteem in dat tot 31 augustus 1988, onverminderd de uitvoering van lid 2, voorziet dat bij verzending van olijfolie van postonderverdelingen 15.07 A I a) en b) van het gemeenschappelijk douanetarief in onmiddellijke verpakkingen met een netto-inhoud van meer dan 5 liter of onverpakt, vanuit deze Lid-Staten met bestemming Spanje en Portugal, de verzender aan moet tonen, tot voldoening van deze Lid-Staten, dat deze olie niet van oorsprong is uit Tunesië.
