F. whereas, in the longer term, the use of IT in dispute resolution and settlement will necessitate fundamental changes in procedural law and in the way legislation is conceived and drafted, and efficient access to the law and justice will require the linking of registers (commercial and companies registers, land registers, registers of wills, etc.); whereas Parliament has already been concerned to make access to justice more compatible with the use of IT in its treatment of legislation on small claims, the European enforcement order and mediation; whereas the use of IT is be encouraged in all areas, including the submission, distribution and service of documents, the giving of evidence and the treatment of legal aid applications, and hence reflected in all future legislative proposals; whereas action in the areas of electronic acts, transparency of debtors' assets and evidence could already be contemplated,
F. overwegende dat op lange termijn de toepassing van IT bij geschilbeslechting fundamentele veranderingen in het procesrecht vereist en in de wijze waarop wetgeving wordt geconcipieerd en opgesteld en dat efficiënte toegang tot recht en rechtspleging het koppelen van registers vergt (handels- en bedrijfsregisters, kadasters, testamentregisters, enz.); voorts overwegende dat het Parlement al betrokken is geweest bij het meer compatibel maken van de toegang tot rechtspleging met de toepassing van IT bij de behandeling van wetgeving voor geringe vorderingen, het Europese betalingsbevel en bemiddeling; overwegende dat de toepassing van IT op alle terreinen wordt aangemoedigd, zoals bij de verschaffing, de distributie en de betekening van stukken, de bewijslevering en de behandeling van aanvragen voor rechtsbijstand, en dan ook weerspiegeld moet worden in alle toekomstige wetgevingsvoorstellen; overwegende dat optreden op het terrein van elektronische besluiten, transparantie van activa van debiteuren en bewijsvoering eveneens kunnen worden overwogen,
