4. This Directive and the implementing measures adopted pursuant to it shall be without prejudice to Community waste management legislation and Community chemicals legislation, including Community legislation on fluorinated greenhouse gases.

L. whereas, where the Treaty expressly provides for them, soft law instruments are legitimate, provided that they are not used as a surrogate for legislation where the Community has legislative power and where Community-wide regulation still appears necessary having due regard to the principles of subsidiarity and proportionality, since this would also constitute a breach of the principle of conferred specific powers, and whereas this applies a fortiori to Commission communications purporting to interpret Community legislation; whereas preparatory instruments, such as green and white papers, also constitute a legitimate use of soft law, in common with notices and guidelines published by the Commission in order to explain how it applies competition and state-aid policy,
L. overwegende dat voor zover het Verdrag uitdrukkelijk in soft law voorziet, soft law-instrumenten legitiem zijn, mits zij maar niet gebruikt worden als een surrogaat voor wetgeving op gebieden waarop de Gemeenschap wetgevende bevoegdheden heeft en waarop een communautaire regeling ook met inachtneming van het subsidiariteit- en evenredigheidsbeginsel geboden lijkt, aangezien dit een schending zou betekenen van het beginsel van toekenning van specifieke bevoegdheden, en overwegende dat dit a fortiori van toepassing is op de mededelingen van de Commissie waarin Gemeenschapswetgeving wordt geïnterpreteerd; overwegende dat voorbereidende instrumenten, zoals groen- en witboeken ook een legitiem gebruik van soft law vormen, evenals nota's en handleidingen die de Commissie publiceert om uit te leggen hoe zij het mededingings- en overheidssteunbeleid toepast;

57. Urges the Member States to transpose Community legislation appropriately and promptly in order to ensure that all EU citizens enjoy the same level of rights as conferred by Community legislation; calls on the Commission to ensure more actively that provisions of Community legislation are applied; encourages the Commission to work in partnership with Member States´ governments to inform citizens of their right of access to justice and redress should their rights be infringed;
57. dringt er bij de lidstaten op aan de Gemeenschapswetgeving op passende wijze en prompt in nationale wetgeving om te zetten om te waarborgen dat alle burgers van de EU aanspraak op rechten hebben van hetzelfde niveau als die welke op grond van de Gemeenschapswetgeving voor hen gelden; doet een beroep op de Commissie er actiever naar te streven dat de bepalingen van het Gemeenschapsrecht worden toegepast; moedigt de Commissie aan om in een partnerschap met de regeringen van de lidstaten de burgers op de hoogte te stellen van hun recht op toegang tot justitie en op een schadevergoeding bij inbreuk op hun rechten;

(i)there is corresponding Community legislation, in particular related to waste, and if requirements that are at least as stringent as those laid down in the Community legislation have been introduced in national legislation transposing such Community legislation,

C. whereas correct and swift implementation of Community legislation is an integral and essential part of "better regulation"; whereas clear and well-written legislation is an indispensable condition for the good application of Community law throughout the European Union; whereas the quality of legislation and the clarity of the obligations incumbent on Member States are not always satisfactory owing to the fact that the legislation is often the result of difficult political compromises,
C. overwegende dat een correcte en snelle tenuitvoerlegging van het Gemeenschapsrecht een integraal en essentieel bestanddeel vormt van "betere regelgeving"; overwegende dat een heldere en goed geformuleerde wetgeving een onontbeerlijke voorwaarde is voor de behoorlijke toepassing van het Gemeenschapsrecht in de gehele Europese Unie; overwegende dat de kwaliteit van de wetgeving en duidelijkheid inzake de verplichtingen van de lidstaten niet altijd bevredigend zijn, daar de wetgeving dikwijls het resultaat is van moeizame politieke compromissen,

2. Insists that any reduction in the amount of legislation must be off-set by more emphasis on implementation; stresses that complaints are a cost-effective and efficient tool for monitoring the application of Community law and calls on the Commission to make sure that at least some of the resources previously allocated to the drafting and follow-up of legislation are dedicated to the effective and correct implementation of existing Community legislation in the various units dealing with individual complaints and infringement cases;
2. houdt vast aan het standpunt dat een vermindering van de kwantitatieve omvang van de wetgeving hand in hand moet gaan met meer nadruk op de tenuitvoerlegging; beklemtoont dat klachten een kosteneffectief en doeltreffend instrument vormen voor het toezicht op de toepassing van het Gemeenschapsrecht en roept de Commissie ervoor te zorgen dat ten minste een deel van de middelen die vroeger werden uitgetrokken voor de opstelling en follow-up van wetgeving wordt besteed aan de doeltreffende en juiste tenuitvoerlegging van de bestaande Gemeenschapswetgeving in de verschillende eenheden die individuele klachten en inbreukdossiers behandelen;

6. The Commission shall ensure that total annual allocations from the EAFRD originating from the EAGGF Guidance Section for any Member State pursuant to this Regulation, and from the ERDF, the ESF and the CF, according to the Community legislation laying down general provisions governing these Funds for the period from 1 January 2007 to 31 December 2013, including the contribution of ERDF according to the Community legislation governing the European Neighbourhood Instrument, from the Instrument for Pre-Accession, according to the Community legislation governing that instrument, and from the part of the FIFG contributing to the Convergence Objective, shall not exceed 4 % of that Member State’s GDP as estimated at the time of the adoption of the Interinstitutional Agreement on budgetary discipline and improvement of the budgetary procedure.
6. De Commissie ziet erop toe dat voor een lidstaat de jaarlijkse toewijzing overeenkomstig deze verordening uit het EOGFL, afdeling Oriëntatie, uit het EFRO, het ESF en het CF, overeenkomstig de communautaire regelgeving inzake deze fondsen voor het tijdvak 1 januari 2007-31 december 2013, met inbegrip van de bijdrage van het EFRO overeenkomstig de communautaire regelgeving houdende algemene bepalingen inzake het Europees Nabuurschapsinstrument, uit het Pretoetredingsinstrument, overeenkomstig de communautaire regelgeving inzake dat instrument, en uit het deel van het Financieringsinstrument voor de Oriëntatie van de Visserij, dat tot de verwezenlijking van de convergentiedoelstelling bijdraagt, in totaal niet meer bedragen dan 4 % van het BBP van die lidstaat zoals geschat bij de aanneming van het Interinstitutioneel Akkoord over de begrotingsdiscipline en de verbetering van de begrotingsprocedure.
