Under the provisions of the Construction Products Directive (89/106/EEC), Member States retained the competence to establish performance requirements for construction products, but only on condition that they did not impede the free movement of CE-marked products.

The proposal for a Regulation on harmonised conditions for the marketing of the construction products (COM(2008)311) is intended to update, simplify and replace the Construction Products Directive in light of changed circumstances concerning e.g. market surveillance, including the New Legislative framework (the Regulation 765/2008/EC on market surveillance and the Decision 768/2008/EC on common framework for the marketing of products).

To improve the internal market for construction products, the European Commission has today proposed to replace the “Construction Product Directive” (89/106/EEC) by a new Regulation aiming to remove all remaining regulatory and technical obstacles to the free circulation of construction products in the European Economic Area.

The possibility, provided for in Article 24(3), second subparagraph, of formulating technical specifications in terms either of performance or of functional requirements, too, may lead to problems in connection with construction products, since they are subject to complex conformity certification under the construction products Directive (insofar as European standards exist).

2. Construction products All construction products are governed by a single Directive (89/106/EEC of 21 december 1988) which requires adoption of technical specifications, be they harmonized standards, European technical approvals or recognized technical specifications.
