In order to avoid any weakening of the control system, in particular as to the sampling for the cross-compliance on-the spot-checks, follow-up checks carried out in reference to the de minimis rule, provided for in Article 97(3) of Regulation (EU) No 1306/2013 should not be taken into account in the calculation establishing the cross-compliance minimum control sample.

The control sample in respect of the on-the-spot checks of the area-related aid schemes should be made on the basis of a stratified sampling method in order to keep the administrative burden in proportion and the number of beneficiaries to be checked on-the-spot to a reasonable level.

4. Without prejudice to any control measures carried out by the Member States in accordance with national laws, regulations and administrative provisions and without prejudice to the provisions of Article 188 a of the Treaty and control measures carried out in accordance with Article 209 (c) of the Treaty, Commission officials or agents may carry out spot checks, including sample checks, in respect of projects financed under this Regulation and may examine the control systems and measures established by the national authorities, which shall inform the Commission of measures taken to that end.
4. Onverminderd de controles van de Lid-Staten overeenkomstig de nationale wettelijke en bestuursrechtelijke bepalingen en onverminderd het bepaalde in artikel 188 A van het Verdrag en de controles op grond van artikel 209, onder c), van het Verdrag, mogen ambtenaren of andere personeelsleden van de Commissie de uit hoofde van deze verordening gefinancierde projecten, met name steekproefsgewijs, ter plaatse controleren en de controlesystemen en -maatregelen onderzoeken die zijn opgezet door de nationale autoriteiten, die de Commissie van de ter zake genomen maatregelen in kennis stellen.
