(13) According to the recommendations made by the Article 29 Data Protection Working Party and contained in the 'Working document on data protection and privacy implications in eCall initiative', adopted on 26 September 2006[9], any processing of personal data through the eCall in-vehicle system should comply with the personal data protection rules provided for in Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data[10] and in Directive 2002/58/EC of the European Parliament and of the Council of 12 July 2002 concerning the processing of personal data and the protection of privacy in the electronic communications sector (Directive on privacy and electronic communications)[11], in particular to guarantee that vehicles equipped with eCall in-vehicle systems, in their normal operational status related to 112 eCall, are not traceable and are not subject to any constant tracking and that the minimum set of data sent by the in-vehicle eCall system includes the minimum information required for the appropriate handling of emergency calls.

The EDPS appreciates the general attention devoted to data protection in the Communication which emphasises the need to ensure high data quality, data security and data protection and recalls that whatever the combination or sequence used for exchanging information, the rules on data protection, data security and data quality as well as the purpose for which the instruments may be used must be respected.

The protection of individuals with regard to the processing of personal data by the Member States is governed by Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the protection of individuals with regard to the processing of personal data by the Commission is governed by Regulation (EC) No 45/2001 of the European Parliament and of the Council of 18 December 2000 on the protection of individuals with regard to the processing of personal data by the Community institutions and bodies and on the free movement of such data in particular as regards the requirements of confidentiality and security of processing, the transfer of personal data from the Commission to the Member States, the lawfulness of processing, and the rights of data subjects to information, access to and rectification of their personal data.

Indeed, the European Parliament, the Conference of data protection authorities, and even the Council of Europe's T-PD Consultative Committee — consisting of data protection representatives of European governments — have all made clear in various occasions that the applicability of the Framework Decision to domestic processing of personal data is an essential condition not only to ensure a sufficient protection of personal data but also to allow an efficient cooperation between law enforcement authorities (18).

(14) The protection of individuals with regard to the processing of personal data is solely governed by Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data(19) and Directive 97/66/EC of the European Parliament and of the Council of 15 December 1997 concerning the processing of personal data and the protection of privacy in the telecommunications sector(20) which are fully applicable to information society services; these Directives already establish a Community legal framework in the field of personal data and therefore it is not necessary to cover this issue in this Directive in order to ensure the smooth functioning of the internal market, in particular the free movement of personal data between Member States; the implementation and application of this Directive should be made in full compliance with the principles relating to the protection of personal data, in particular as regards unsolicited commercial communication and the liability of intermediaries; this Directive cannot prevent the anonymous use of open networks such as the Internet.
(14) De bescherming van individuen met betrekking tot de verwerking van persoonsgegevens is alleen geregeld bij Richtlijn 95/46/EG van het Europees Parlement en de Raad van 24 oktober 1995 betreffende de bescherming van natuurlijke personen in verband met de verwerking van persoonsgegevens en betreffende het vrije verkeer van die gegevens(19) en bij Richtlijn 97/66/EG van het Europees Parlement en de Raad van 15 december 1997 betreffende de verwerking van persoonsgegevens en de bescherming van de persoonlijke levenssfeer in de telecommunicatiesector(20), die volledig van toepassing zijn op diensten van de informatiemaatschappij. Die richtlijnen vormen reeds een communautair wettelijk kader op het gebied van persoonsgegevens, en het is daarom niet nodig die kwestie in deze richtlijn op te nemen om een soepele werking van de interne markt te garanderen, met name wat betreft het vrije verkeer van persoonsgegevens tussen lidstaten.
