Member States referred to in the third subparagraph of Article 2(2) of Directive 92/79/EEC which levy an excise duty of at least EUR 77 per 1 000 cigarettes irrespective of the weighted average retail selling price, may, from 1 January 2014, apply a quantitative limit of not less than 300 items as regards cigarettes brought into their territory without further payment of excise duties from a Member State which applies a lower excise duty in accordance with the third subparagraph of Article 2(2) of that Directive.

Without prejudice to Article 32, Member States not referred to in the third subparagraph of Article 2(2) of Directive 92/79/EEC may, as regards cigarettes which may be brought into their territory without further payment of excise duties, apply from 1 January 2014 a quantitative limit of not less than 300 items with respect to cigarettes brought in from a Member State which applies, in accordance with the third subparagraph of Article 2(2) of that Directive, lower excise duties than those resulting from the provisions of the first subparagraph of Article 2(2) thereof.

In order to avoid distortion of competition and unacceptable diversions of trade and the resulting revenue loss for those Member States which apply high excise duties, both as an important source of revenue and for health reasons, it appears necessary to allow the latter to apply quantitative limits as regards cigarettes which may be brought into their territory without further payment of excise duties where those cigarettes are brought into their territory from Member States benefiting from transitional periods.

(14a) Travellers taking a flight or sea-crossing to a third territory or to a third country, holding a transport document stating that the final destination is an airport or port situated in a third territory or in a third country, should be able to benefit from the exemption from payment of excise duty on excise goods supplied by tax-free shops.

This new Chapter provides a much wider circle of persons who shall be allowed to act as guarantor (Article 17); defines when a movement under suspension of excise duty shall be deemed to begin and end (Article 19); provides that a movement of excise goods shall be considered to take place under suspension of excise duty only if it takes place under cover of an electronic administrative document that replaces the current paper accompanying document (Article 20); provides that the Member States may allow the consignor to split a movement of energy products (Article 22); provides for the use of an electronic 'report of receipt' or a 'report of export' (Articles 23 and 24); provides for procedures to be used in the absence of electronic reports (Article 25) or when the computerised system is not available (Article 26); introduces other simplification arrangements (Articles 28 and 29).

In the case of exemption from excise duty on goods procured from indigenous sources, it was found that the duty paid on purchases by a non-EOUS unit can be used as a credit for its own future duty liabilities, e.g. towards payment of excise duty on domestic sales (the so-called Cenvat mechanism).

A legal framework is therefore created whereby the Member States are able to levy the excise duty from the persons to whom the intra-Community movements relate (Article 7(3)) and provisions are laid down in order to enable the excise duty initially paid in the Member State of acquisition to be reimbursed following payment of the excise in the Member State of destination (Article 7(6) and Article 10(4)).

(2) Since then, however, although the figures for intra-Community movements of tax-paid products remain relatively low, more and more traders have tended to interpret Articles 7 to 10 of Directive 92/12/EEC in such a way as to legitimise trade practices involving payment of excise duty in the Member State where the products are acquired, and a growing number of private individuals are buying products in another Member State for their personal use and legitimately paying excise duty for them in the Member State of purchase .
(2) Ofschoon de omvang van het intracommunautaire verkeer van veraccijnsde goederen nog steeds relatief beperkt is, zijn sindsdien toch steeds meer bedrijven ertoe geneigd de bepalingen van de artikelen 7 tot en met 10 van Richtlijn 92/12/EEG aldus uit te leggen, dat zij handelspraktijken kunnen rechtvaardigen waarbij de accijns in de lidstaat van verkrijging van de goederen wordt betaald en kopen steeds meer particulieren producten voor hun persoonlijke behoeften in een andere lidstaat en betalen zij daarvoor op legitieme wijze accijns in de lidstaat van aankoop .

Where an irregularity or offence has been committed in the course of a movement involving the chargeability of excise duty, the excise duty shall be due in the Member State where the offence or irregularity was committed from the natural or legal person who guaranteed payment of the excise duties in accordance with Article 15 (3), without prejudice to the bringing of criminal proceedings.
