3. Without prejudice to paragraphs 1 and 2 of this Article, and subject to entry into force of the implementing measures referred to in Article 4(3), Article 5(4) and in the first subparagraph of Article 6(2), if a manufacturer so requests, national authorities may not, on grounds relating to emissions of vehicles, refuse to grant EC type-approval or national type-approval for a new type of vehicle or engine, or prohibit the registration, sale or entry into service of a new vehicle and the sale or use of new engines, where the vehicle or engines concerned comply with this Regulation and its implementing measures.

4. By way of derogation from paragraph 1, and unless otherwise provided for in this Regulation or in one of the delegated acts adopted pursuant to this Regulation, Member States may permit the making available on the market or entry into service of components or separate technical units which are intended for mounting on vehicles which, when made available on the market or entered into service, were not required to be type-approved by this Regulation or by Directive 2002/24/EC.
4. In afwijking van lid 1, en tenzij in deze verordening of in een van de op grond van deze verordening vastgestelde gedelegeerde handelingen anders is bepaald, mogen de lidstaten het op de markt aanbieden of het in het verkeer brengen van onderdelen of technische eenheden toestaan die bestemd zijn voor montage op voertuigen waarvoor, op het moment dat zij op de markt werden aangeboden of in het verkeer werden gebracht, geen typegoedkeuring was vereist op grond van deze verordening of Richtlijn 2002/24/EG.

9. Without prejudice to paragraphs 1 to 8 of this Article and subject to the entry into force of the measures adopted pursuant to Article 4(6), if a manufacturer so requests, the national authorities shall not, on grounds relating to pedestrian protection, refuse to grant EC type-approval or national type-approval for a new type of vehicle or prohibit the registration, sale or entry into service of a new vehicle, where the vehicle concerned complies with the technical provisions set out in Sections 3 or 4 of Annex I.
9. 5. Notwithstanding the provisions of paragraphs 2 and 4 above, for the purposes of replacement parts, Member States shall permit the sale or entry into service of replacement brake linings intended for fitting to vehicle types for which type-approval was granted prior to the entry into force of this Directive and on condition that such replacement brake linings do not contravene the provisions of the previous version of Directive 71/320/EEC which was applicable at the time of entry into service of these vehicles.
5. Onverminderd de leden 2 en 4 staan de lidstaten de verkoop of het gebruik toe van vervangingsremvoeringen bestemd voor montage op voertuigtypen waarvoor typegoedkeuring is verleend vóór de vankrachtwording van deze richtlijn en op voorwaarde dat dergelijke vervangingsremvoeringen niet in strijd zijn met de voorschriften van de vorige versie van Richtlijn 71/320/EEG die van toepassing was toen het voertuigtype in het verkeer werd gebracht.
