APPRECIATES that the Commission will provide technical guidance in 2006 on integrated environmental management, including environmental objectives, measures and instruments, by giving examples of good practice and referring to the relevant EU environmental legislation; CALLS on the European Union, Member States and their cities, within their respective responsibilities to improve the quality of life in cities and urban areas by promoting and implementing integrated environmental management, with a particular focus on reducing greenhouse gas emissions and improving energy efficiency and sustainable use of resources in cities, covering in particular environmentally friendly and sustainable transport and land use planning, sustainable urban design as well as sustainable construction and operation of buildings, green public procurement and the promotion of sustainable production and consumption patterns and life-styles among citizens; UNDERLINES the important role of integrated environmental management systems such as EMAS or ISO 14001 for implementation;

(2) ACKNOWLEDGES that environmental protection implies particular challenges that make it in many ways distinct from other subjects of policy and legislation, and that should be taken into account when drafting, implementing and enforcing environmental law. (3) STRESSES that environmental protection has, in fact, to take into account, inter alia: the environmental media (air, water, soil) and living organisms (human, flora and fauna) as well as their inter-relationships; constantly changing environmental situations; the developing state of scientific knowledge and the close relation of environmental protection with complex and developing technology; a broad number of public and private actors involved; competences for the transposition and practical application of the law often devolved to and shared between different levels of public administration; and, last but not least, the fact that the environment is a common good frequently not linked to a private interest. (4) CONSIDERS that these characteristics and circumstances, although not entirely exclusive of environmental protection, help to explain why the implementation and enforcement of environmental law, and in particular of Community environmental law, are so complex and not always satisfactory and why they require particular efforts from all actors involved in order to achieve the objectives set by environmental law.
(2) ERKENT dat de milieubescherming bijzondere uitdagingen met zich meebrengt waardoor zij zich in velerlei opzicht onderscheidt van andere beleids- en wetgevingsthema's, hetgeen in aanmerking moet worden genomen bij de opstelling, tenuitvoerlegging en handhaving van het milieurecht ; (3) BENADRUKT dat er in concreto bij de milieubescherming rekening moet worden gehouden met, onder andere : de milieucompartimenten (lucht, water, bodem) en levende organismen (mens, flora en fauna) alsmede de correlaties daartussen ; voortdurend veranderende milieusituaties ; de stand van de wetenschappelijke kennis en de nauwe relatie tussen milieubescherming en gecompliceerde technologie in ontwikkeling ; de betrokkenheid van een groot aantal actoren in de overheids- en de privésector ; het feit dat bevoegdheden voor de omzetting en de praktische toepassing van de wet vaak verleend worden aan en gedeeld worden door verschillende bestuursniveaus ; en zeker het feit dat het milieu een gemeenschappelijk goed is waarbij privébelangen veelal geen rol spelen ; (4) IS VAN OORDEEL dat die kenmerken en omstandigheden, ook al gelden zij niet uitsluitend voor de milieubescherming, mede verklaren waarom de tenuitvoerlegging en de handhaving van het milieurecht, en in het bijzonder het milieurecht van de Gemeenschap, zo gecompliceerd en niet altijd bevredigend zijn en waarom daarvoor van alle betrokken actoren bijzondere inspanningen vereist zijn om de doelstellingen van het milieurecht te bereiken ;
