The Group of Experts appointed by the Scientific and Technical Committee has advised that the basic safety standards, established according to Articles 30 and 31 of the Euratom Treaty, should take into account the new recommendations of the International Commission on Radiological Protection (ICRP), in particular those in ICRP Publication 103 , and should be revised in the light of new scientific evidence and operational experience.

At its meeting of 31 March 2009, while noting that the Commission’s apparent failure to obtain a new opinion on the basic standards from a group of persons appointed by the Scientific and Technical Committee before presenting its new proposal would constitute an infringement of an essential procedural requirement which, pursuant to Article 230 (second subparagraph) EC, constitutes a ground of review of the act thus adopted, the Committee on Legal Affairs accordingly decided, by 13 votes in favour, 6 votes against and no abstentions, to recommend that the appropriate legal basis is Articles 31 and 32 of the EURATOM Treaty.
Op haar vergadering van 31 maart 2009 besloot de Commissie juridische zaken met 13 stemmen vóór en 6 tegen, bij 0 onthoudingen, aan te bevelen dat de passende rechtsgrondslag in dit geval de artikelen 31 en artikel 32 van het Euratom-Verdrag zijn, waarbij zij evenwel aantekende dat het feit dat de Commissie kennelijk had nagelaten om vóór de presentatie van haar nieuwe voorstel een nieuw advies in te winnen inzake de door een groep van personen welke zou moeten worden aangewezen door het Wetenschappelijk en Technisch Comité vast te stellen basisnormen, zou neerkomen op een schending van een wezenlijk vormvoorschrift, die volgens artikel 230 (tweede alinea) EG, aanleiding zou vormen voor een herziening van het aldus aangenomen besluit.

(ab) improving scientific and technical knowledge of the fisheries in question, taking into account the existing and necessary work in the field carried out at the appropriate regional level and taking into consideration the likely impact of fishing on the environment, in particular by proposing to its partners the setting-up of scientific and technical committees at the appropriate level;
a ter) het vergroten van de wetenschappelijke en technische kennis met betrekking tot de betreffende visserijtakken en daarbij rekening houden met wat op het passende regionale niveau reeds wordt gedaan en moet worden gedaan, alsmede met de te verwachten effecten van de visserij op het milieu, met name door de partners voor te stellen wetenschappelijke en technische comités op gepast niveau in het leven te roepen;
