This report fails to provide any response to the dangers arising from accession by the EU to the European Convention on Human Rights, which has the consequence that the European Court of Human Rights in Strasbourg can give judgment on any legal act by the EU. Judges at the European Court of Justice in Luxembourg warned us in advance that this step would make it impossible for the European legal order in its existing form to function properly any longer.

Following the failure of the Luxembourg Convention, the Commission's Green Paper on the Community patent and the European patent system [2], which was part of the follow-up to the First Action Plan for Innovation in Europe [3], launched a broad discussion on the need to take new initiatives in relation to patents.

Paragraph 2, which incorporates the content of Article 68(3) of the Luxembourg Convention, provides for international jurisdiction to be vested in the courts of the Member State in which the European Patent Organisation has its headquarters, for situations where no court of another Member State has jurisdiction under Articles 47 and 48 and paragraph 1 of the Article concerned.

This Convention shall not prejudice the application by the Member States of the European Community of the Council Regulation (EC) No 44/2001 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters, as well as any amendments thereof, of the Convention on Jurisdiction and the Enforcement of Judgments in Civil and Commercial Matters, signed at Brussels on 27 September 1968, and of the Protocol on interpretation of that Convention by the Court of Justice of the European Communities, signed at Luxembourg on 3 June 1971, as amended by the Conventions of Accession to the said Convention and the said Protocol by the States acceding to the European Communities, as well as of the Agreement between the European Community and the Kingdom of Denmark on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters, signed at Brussels on 19 October 2005.

However, Belgium, Denmark, the Netherlands and the United Kingdom have neither signed nor ratified the Convention and signatory states such as Austria, Finland, France, Ireland, Italy, Luxembourg, Portugal, Spain and Sweden have not yet begun the ratification process.

With regard to the issue of a conflict between the rulings of the Court in Strasbourg and rulings in Luxembourg, it is worth noting that today, under Community law, the Court of Justice of the European Communities always refers to the European Convention on Human Rights, to actual decisions by the European Court of Human Rights, as the source of inspiration for decisions by the Court of Justice of the European Communities on fundamental rights issues.
