Arrangements for determining responsibility for considering asylum applications were initially part of the intergovernmental Schengen Convention, and were replaced with the Convention determining the State responsible for examining applications for asylum lodged in one of the Member States of the European Communities, known as the "Dublin Convention"[9].

(5a) As regards the introduction in successive phases of a Common European Asylum System that should lead, in the longer term, to a common procedure and a uniform status, valid throughout the Union, for those granted asylum, it is appropriate at this stage, while making the necessary improvements in the light of experience, to confirm the principles underlying the Convention determining the State responsible for examining applications for asylum lodged in one of the Member States of the European Communities, signed in Dublin on 15 June 1990 (the Dublin Convention), whose implementation has stimulated the process of harmonising asylum policies.

WHEREAS the Council of the European Union has adopted Council Regulation (EC) No 343/2003 of 18 February 2003 establishing the criteria and mechanisms for determining the Member State responsible for examining an asylum application lodged in one of the Member States by a third-country national (hereinafter referred to as the Dublin Regulation), which replaced the Convention determining the State responsible for examining applications for asylum lodged in one of the Member States of the European Communities, signed in Dublin on 15 June 1990 (hereinafter referred to as the Dublin Convention), and whereas the Commission of the European Communities has adopted Regulation (EC) No 1560/2003 of 2 September 2003 laying down detailed rules for the application of Council Regulation (EC) No 343/2003 establishing the criteria and mechanisms for determining the Member State responsible for examining an asylum application lodged in one of the Member States by a third-country national, hereinafter referred to as the ‘Dublin implementing Regulation’.
OVERWEGENDE dat de Raad van de Europese Unie Verordening (EG) nr. 343/2003 van 18 februari 2003 heeft aangenomen tot vaststelling van de criteria en instrumenten om te bepalen welke lidstaat verantwoordelijk is voor de behandeling van een asielverzoek dat door een onderdaan van een derde land bij een van de lidstaten wordt ingediend („de Dublin-verordening”), die in de plaats is gekomen van de op 15 juni 1990 te Dublin ondertekende Overeenkomst betreffende de vaststelling van de staat die verantwoordelijk is voor de behandeling van een asielverzoek dat bij een van de lidstaten van de Europese Gemeenschappen wordt ingediend („de overeenkomst van Dublin”), en dat de Commissie van de Europese Gemeenschappen Verordening (EG) nr. 1560/2003 van 2 september 2003 heeft aangenomen houdende uitvoeringsbepalingen van Verordening (EG) nr. 343/2003 van de Raad tot vaststelling van de criteria en instrumenten om te bepalen welke lidstaat verantwoordelijk is voor de behandeling van een asielverzoek dat door een onderdaan van een derde land bij een van de lidstaten wordt ingediend („de verordening met uitvoeringsbepalingen voor Dublin”).

In order to achieve that goal, the regulation provides for temporary derogation from certain provisions of the acquis communautaire on visas, which includes Regulation No 539/2001 as well as the procedures and conditions for issuing visas as defined by the Schengen Convention and the measures taken to implement it, in particular the Common Consular Instructions, which lay down inter alia the type of visa to be issued, the Member State responsible for examining applications and the conditions governing the receipt and examination of applications and the decision on issuing a visa.
Om dit doel te bereiken voorziet de verordening in tijdelijke afwijking van enkele bepalingen van de Gemeenschapswetgeving inzake visa, o.m. (1) On 16 February 1996 the Commission gave the European Parliament and the Council its Report on the state of application of the general system for the recognition of higher-education diplomas made in accordance with Article 13 of Council Directive 89/48/EEC of 21 December 1988 on a general system for the recognition of higher-education diplomas awarded on completion of professional education and training of at least three years' duration(4). In this Report the Commission undertook to examine the possibility of incorporating into that Directive the obligation to take into consideration, when examining applications for recognition, experience gained following the award of the qualification in question, the possibility of introducing the concept of "regulated education and training". The Commission also undertook to examine the arrangements whereby the role of the Coordinating Group set up by Article 9(2) of Directive 89/48/EEC could be developed in order to ensure more uniform application and interpretation of the Directive.
