Against the background of the Council's piecemeal legislation to date which has only partly tackled organized crime, a coherent strategy with comprehensive and balanced proposals on how to proceed further is a useful development. It is also sensible that each recommendation assigns responsibility for the measures to be taken and a deadline for their implementation; thus a certain amount of pressure can be brought to bear on the services responsible for implementing each recommendation on time. However, the Action Plan has several shortcomings, leaving open some particularly important structural issues which it would be better to clarify at the beginning of any action programme; it also goes into detail on some already well-rehearsed topics while only briefly outlining other important problem areas or omitting them altogether. Its main weakness is that it makes no clear decision on whether efforts should be made to combat organized crime in future by harmonizing the main definitions of crime and criminal court procedures or by improving cooperation between the Member States, while maintaining the differences in national criminal law systems. The introduction to the Action Plan states only that this question needs further consideration.

(15) Whereas, pending the adoption of a Directive on investment services harmonizing inter alia the definition of the concept of regulated market, for the purposes of this Directive and without prejudice to such future harmonization that concept must be defined provisionally; whereas that definition will be replaced by that harmonized at Community level which will give the home Member State of the market the responsibilities for these matters which this Directive transitionally gives to the insurance undertaking's home Member State;
