Tobacco still remains the biggest avoidable cause of premature death in the EU, and the illicit trade in tobacco facilitates access to cigarettes and other tobacco products, including for children and young adults. In addition, millions of euros in tax revenues are lost every year as a result of the illicit trade.

The legal acts adopted today are in line with the Framework Convention on Tobacco Control (FCTC) Protocol to Eliminate Illicit Trade in Tobacco Products, which the EU ratified in 2016.

Today the EU has taken a big step forward in combatting the illicit trade in tobacco products.

The FCTC provisions on the regulation of the contents of tobacco products, the regulation of tobacco product disclosures, the packaging and labelling of tobacco products, advertising and illicit trade in tobacco products are particularly relevant.
Van bijzonder belang zijn de FCTC-bepalingen inzake de reglementering van de inhoud van tabaksproducten, de reglementering van vermeldingen op tabaksproducten, de verpakking en etikettering van tabaksproducten, reclame en illegale handel in tabaksproducten.

The Programme should be implemented taking into account the recommendations and measures listed in the Commission communication of 6 June 2013 entitled ‘Stepping up the fight against cigarette smuggling and other forms of illicit trade in tobacco products — A comprehensive EU Strategy’.
Het programma moet worden uitgevoerd met inachtneming van de aanbevelingen en maatregelen die vervat zijn in de mededeling van de Commissie van 6 juni 2013 met als titel „Intensivering van de bestrijding van sigarettensmokkel en andere vormen van illegale handel in tabaksproducten — Een integrale EU-strategie”.

The size of the internal market in tobacco and related products, the increasing tendency of manufacturers of tobacco products to concentrate production for the entire Union in only a small number of production plants within the Union and the resulting significant cross-border trade of tobacco and related products calls for stronger legislative action at Union rather than national level to achieve the smooth functioning of the internal market.
Wegens de omvang van de interne markt voor tabaks- en aanverwante producten, het feit dat de producenten van tabaksproducten de productie voor de gehele Unie meer en meer in slechts een klein aantal fabrieken in de Unie concentreren, en de daaruit resulterende significante grensoverschrijdende verkoop van tabaks- en aanverwante producten, is er om de interne markt voor tabaksproducten goed te laten functioneren, behoefte aan een krachtiger wetgevend optreden op het niveau van de Unie, eerder dan op nationaal niveau.

7. Member States shall ensure that the manufacturers of tobacco products provide all economic operators involved in the trade of tobacco products, from the manufacturer to the last economic operator before the first retail outlet, including importers, warehouses and transporting companies, with the equipment that is necessary for the recording of the tobacco products purchased, sold, stored, transported or otherwise handled.
7. De lidstaten zorgen ervoor dat de producenten van tabaksproducten alle marktdeelnemers die betrokken zijn bij de handel in tabaksproducten, van de producent tot en met de laatste marktdeelnemer vóór de eerste detaillist, met inbegrip van de importeurs, opslagplaatsen en transportondernemingen, voorzien van de apparatuur die nodig is voor het registreren van de tabaksproducten die worden gekocht, verkocht, opgeslagen, getransporteerd of anderszins behandeld.
