The Applicant submits seven grounds of challenge concerning infringement of an essential procedural requirement, as well as infringement of the Treaties and of rules of law relating to their application: violation of the right of hearing; insufficient statement of reasons; violation of the right of defence; manifest error of assessment; breach of the fundamental principle of proportionality; breach of the fundamental principle of equal treatment and nondiscrimination; and breach of the fundamental right to property.
Verzoekster baseert haar beroep op zeven middelen inzake schending van een wezenlijk vormvoorschrift alsook van de Verdragen en de voor de toepassing daarvan geldende rechtsregels: schending van het recht om te worden gehoord; ontoereikende motivering; schending van het recht van verweer; kennelijk onjuiste beoordeling; schending van het fundamentele evenredigheidsbeginsel; schending van het fundamentele beginsel van gelijke behandeling en van het discriminatieverbod en schending van het fundamentele eigendomsrecht.

Recalls that the non-respect of a deadline for the transposition of a directive is an infringement of the Treaties, like any other non-respect of substantive provisions, and must be seen and treated accordingly; welcomes in this respect the possibility created by the Treaty of Lisbon for a lump sum payment or penalty to be imposed in such cases on the Member State concerned together with the judgment on the infringement under Article 260(3) TFEU;

Should the European Parliament, the European Council, the Council, the Commission or the European Central Bank, in infringement of the Treaties, fail to act, the Member States and the other institutions of the Union may bring an action before the Court of Justice of the European Union to have the infringement established.
Ingeval het Europees Parlement, de Europese Raad, de Raad, de Commissie, of de Europese Centrale Bank in strijd met de Verdragen, nalaat een besluit te nemen, kunnen de lidstaten en de overige instellingen van de Unie zich wenden tot het Hof van Justitie van de Europese Unie om deze schending te doen vaststellen.
