2. The ECB may, if deemed necessary, instead of the national competent authorities or national designated authorities of the participating Member State, apply higher requirements for capital buffers than applied by the national competent authorities or national designated authorities of participating Member States to be held by credit institutions at the relevant level in accordance with relevant Union law in addition to own funds requirements referred to in point (d) of Article 4(1) of this Regulation, including countercyclical buffer rates, subject to the conditions set out in paragraphs 4 and 5 of this Article, and apply more stringent measures aimed at addressing systemic or macroprudential risks at the level of credit institutions subject to the procedures set out in the Regulation (EU) No 575/2013 and Directive 2013/36/EU in the cases specifically set out in relevant Union law.
2. Indien zulks nodig wordt geacht, kan de ECB, in plaats van de nationaal bevoegde autoriteiten of de nationaal aangewezen autoriteiten van de deelnemende lidstaat, aan de kredietinstellingen strengere kapitaalbuffervereisten opleggen, waaraan zij op het relevante niveau overeenkomstig het Unierecht moeten voldoen, naast de in artikel 4, lid 1, onder d), van deze verordening, bedoelde eigenvermogensvereisten, met inbegrip van anticyclische bufferpercentages, mits aan de voorwaarden van de leden 4 en 5 van dit artikel is voldaan, en strengere maatregelen ter bestrijding van systeemrisico’s of macroprudentiële risico’s op het niveau van kredietinstellingen toepassen in de gevallen die specifiek in het toepasselijke Unierecht worden genoemd, met inachtneming van de procedures die zijn vermeld in de Verordening (EU) nr. 575/2013 en Richtlijn 2013/36/EU.

Recalling the discussions held at the informal meeting in Pörtschach, it agrees that: - the institutions shall be guided as from now by the criteria and practices contained in the "subsidiarity and proportionality Protocol" which will be annexed to the EC Treaty when the Amsterdam Treaty comes into force; - the Commission's annual "Better law-making" report should be the basis for reporting on and examining developments over the past year; future reports should be presented in good time to allow for thorough discussion in the various institutions and bodies concerned (European Parliament, Council, Committee of the Regions, COSAC, Economic and Social Committee) and, therefore, for optimum preparation of the European Council; - the Council should conduct an orientation debate on future Green and White Papers from the Commission in the light of the principle of subsidiarity, not undermining in any way the Commission's right of initiative; - before the Commission proposes a significant new piece of legislation, it should examine whether other Community legislation already existing on the same issue needs to be modified or consolidated, or repealed if no longer justified; - in accordance with Article 189 of the EC Treaty, the European Parliament, the Council and the Commission must safeguard fully the principle according to which directives shall be binding, as to the result to be achieved, upon each Member State to which they are addressed, but shall leave to the national authorities the choice of form and methods; - pursuant to Article 190 of the EC Treaty, legislative acts adopted by the competent institutions should state the reasons on which they are based, with a view to justifying their compliance with the principles of subsidiarity and proportionality The European Council in December 1999 will review the results of the above mentioned elements as well as the experiences with the full application of the protocol on subsidiarity and proportionality.

Following the specific amendments agreed by the Commission, the proposal now: - makes clear that a credit institution that also acted as an investment firm could belong to a single compensation scheme as long as the scheme met the requirements of both the deposit-guarantee Directive and the investor compensation Directive - incorporates equivalent clauses to the bank deposit-guarantee Directive concerning the possibility for branches to opt-in to higher levels of compensation in the host country ('top-up'), the regime for branches of firms with their head office in a non-EU country (Member States must ensure home countries schemes offer equivalent cover or oblige branches to join the host country scheme) and the principle that schemes should be financed by investment firms themselves - includes revised definitions of "investment firm" and "branch" which refer to the definitions in the Investment Services Directive and a new definition of "joint investment" - clarifies that authorisation for investment firms is based on the principle of home country control and that no investment firm (other than credit institutions exempted under the deposit-guarantee Directive) could operate unless it participated in an investor compensation scheme - simplifies the definition of when and how the amount of an investor's claim should be determined - makes a specific reference to the exclusion from compensation of any transaction in connection with which there has been a conviction for money-laundering as defined by the Directive on the issue (91/308/EEC) - includes a requirement for continued coverage by the compensation scheme even when a firm's authorisation to operate has been withdrawn (in case it should subsequently transpire that the firm was unable to meet its commitments to investors) - requires the Commission to report on the Directive's operation three years after it is due to be implemented (31.12.96) rather than five years after.
