The agreement aims to ensure that adequate rules on the protection of intellectual property are applied in all member countries, on the basis of the basic obligations laid down by the World Intellectual Property Organisation (WIPO) in the various conventions on intellectual property rights (the Paris Convention for the Protection of Industrial Property, the Berne Convention for the Protection of Literary and Artistic Works, the Rome Convention for the Protection of Performers, Producers of Phonograms and Broadcasting Organisations, and the Washington Treaty on Intellectual Property in Respect of Integrated Circuits).

Indeed, even if the goals of preservation and human rights are enshrined in a number of international environmental and human rights instruments, these are largely optional and lack in practise the enforcement mechanism of international intellectual property agreements, notably the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS).

The main elements of my development proposal which I first made at the Zurich mini-ministerial in October and for which I have been pressing since are: first, all industrialised WTO members should commit to providing duty- and quota-free access to all products from the least developed countries; second, we should adopt a package of special and differential treatment proposals to confirm the flexibilities for those LDCs that exist in the WTO; third, we must enshrine in the WTO’s intellectual property agreements conditions for better access to cheap drugs against pandemics; and fourth, we should adopt a strong aid for trade package along the lines of what was agreed at the Gleneagles G8 Summit.

There needs to be a sustainable solution for access to medicines that includes a revision of the intellectual property agreement itself.

Third, there is also a more specific development agenda for which the EU intends to take the lead ahead of Hong Kong: ensuring that there is tariff and quota-free access to EU markets for everything, including agricultural products, for the Least Developed Countries; ensuring that action on the trade side is as development friendly as possible in particular for specific commodities such as cotton; providing the right degree of differentiation between developing countries in the implementation of trade rules; enshrining in the WTO ’s intellectual property agreements the conditions for a better access to cheap drugs against pandemics.
