TRADUCTIONS EN CONTEXTE

n. as regards purchases of financial services by public entities, to ensure that the recently adopted EU rules on public procurement are shielded and supported in the framework of the negotiations, in particular regarding SMEs’ access to public contracts, the eligibility criteria based on the best ‘quality-price’ ratio instead of the cheapest price, reserved markets allocated to social economy undertakings and the possibility for contractual authorities to foster inter-community cooperation and to preserve thresholds for tendering exclusion from EU and international rules;
n. er met betrekking tot opdrachten voor financiële diensten van overheden voor te zorgen dat in het kader van de onderhandelingen de onlangs vastgestelde EU-regels inzake openbare aanbestedingen onaangetast blijven, met name wat betreft de toegang van kmo's tot overheidsopdrachten, de subsidiabiliteitscriteria op basis van de beste prijs-kwaliteitsverhouding in plaats van op basis van de laagste prijs, voor ondernemingen van de sociale economie gereserveerde markten en de mogelijkheid voor aanbestedende autoriteiten om intercommunautaire samenwerking te bevorderen en om de drempels voor de uitsluiting van aanbestedingen van EU- en internationale regels te handhaven;

l. to ensure that the recently adopted EU rules on public procurement are shielded and supported in the framework of the negotiations, in particular regarding SMEs’ access to public contracts, eligibility criteria based on the best quality-price ratio instead of the cheapest price, reserved markets allocated to social economy undertakings, the possibility for contractual authorities to foster inter-community cooperation, and the preservation of thresholds for tendering exclusion from EU and international rules; to guarantee that EU undertakings are not discriminated against when applying for public procurement contracts in the US and that they benefit from a transparent access equivalent to that applying to US undertakings in Europe under public procurement rules in the EU;
l. ervoor te zorgen dat de recentelijk vastgestelde EU-regels inzake overheidsopdrachten in de onderhandelingen worden afgeschermd en gesteund, met name de regels inzake de toegang van kmo's tot overheidsopdrachten, het criterium "beste prijs-kwaliteitsverhouding" in plaats van de laagste prijs, markten die worden voorbehouden aan sociale ondernemingen, de mogelijkheid voor aanbestedende autoriteiten om samenwerking tussen gemeenschappen te bevorderen en het behoud van drempels voor vrijstelling van de aanbestedingsplicht uit hoofde van EU- of internationale wetgeving; te waarborgen dat ondernemingen uit de EU niet worden gediscrimineerd wanneer ze meedingen naar overheidsopdrachten in de VS en dat ze een transparante toegang krijgen die gelijkwaardig is aan de toegangsvoorwaarden voor Amerikaanse ondernemingen in Europa zoals bepaald door de regels inzake overheidsopdrachten van de EU;

43. Considers it necessary that the Commission clarify the legal uncertainty regarding inter-communal cooperation which has arisen as a result of the jurisprudence of the Court of Justice;

45. Considers that cases of inter-communal cooperation are not relevant with regard to procurement law if:

(19) Since the objectives of the proposed action concerning the contribution of European cooperation to quality education cannot be sufficiently achieved by the Member States, inter alia, because of the need for multilateral partnerships and multilateral mobility and exchanges of information between the Community and third countries and can therefore be better achieved at Community level owing to the transnational dimension of Community actions and measures, the Community may adopt measures in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty.
(19) Aangezien de doelstellingen van de voorgenomen actie betreffende de bijdrage van de Europese samenwerking aan kwalitatief hoogwaardig onderwijs, met name gezien de noodzaak multilaterale partnerschappen, multilaterale mobiliteit alsmede uitwisseling van informatie tussen de Gemeenschap en derde landen te bevorderen, niet voldoende door de lidstaten kunnen worden verwezenlijkt en ddeze doelstellingen derhalve, gezien de transnationale dimensie van de communautaire acties en maatregelen, beter door de Gemeenschap kunnen worden verwezenlijkt, kan de Europese Gemeenschap overeenkomstig het in artikel 5 van het Verdrag vervatte subsidiariteitsbeginsel maatregelen nemen.

(14) in accordance with the principles of subsidiarity and proportionality as defined in Article 5 of the Treaty, since the objectives of the proposed action concerning the contribution of European cooperation to quality education cannot be sufficiently achieved by the Member States, inter alia, because of the need for multilateral partnerships, multilateral mobility and Community-wide exchanges of information, they can therefore be better achieved by the Community owing to the transnational dimension of the Community actions and measures; this Decision does not go beyond what is necessary to achieve those objectives.
(14) Overeenkomstig het in artikel 5 van het Verdrag vervatte subsidiariteits- en evenredigheidsbeginsel, kunnen de doelstellingen van de voorgenomen actie betreffende de bijdrage van de Europese samenwerking aan onderwijs van hoog gehalte niet voldoende door de lidstaten worden verwezenlijkt, met name gezien de noodzaak multilaterale partnerschappen, multilaterale mobiliteit alsmede uitwisselingen op communautair niveau te bevorderen. Deze doelstellingen kunnen derhalve, gezien de transnationale dimensie van de communautaire acties en maatregelen, beter door de Gemeenschap worden verwezenlijkt.

Within the sphere of their respective competences, the Parties shall cooperate in the field of information, culture and communications, both to create a better mutual understanding and to strengthen cultural ties between them, including, inter alia, through studies and technical assistance for the preservation of cultural heritage.
De partijen, binnen de beperkingen van hun respectieve bevoegdheden, zullen samenwerken op het gebied van informatie, cultuur en communicatie, ter bevordering van wederzijds begrip en ter versterking van de culturele banden.
