1. Sensitive documents are documents originating from the institutions or the agencies established by them, from Member States, third countries or International Organisations, classified as «TRÈS SECRET/TOP SECRET», «SECRET» or «CONFIDENTIEL» in accordance with rules which shall be drawn up by the institution concerned and shall be reviewed by it regularly and which protect essential interests of the European Union or of one or more of its Member States in the areas covered by Article 4(1)(a), notably public security, international and trade relations, and defence and military matters.

Gevoelige documenten zijn documenten die afkomstig zijn van de instellingen of van de agentschappen hiervan, van lidstaten, van derde landen of van internationale organisaties, en die op grond van de regels die de betrokken instelling heeft opgesteld en op gezette tijden herziet, ter bescherming van wezenlijke belangen van de Europese Unie, of van één of meer van haar lidstaten, op de gebieden van artikel 4, lid 1, onder a) - in het bijzonder openbare veiligheid, internationale betrekkingen, handelsbetrekkingen, defensie en militaire aangelegenheden, als "TRÈS SECRET/TOP SECRET", "SECRET" of "CONFIDENTIEL" gerubriceerd zijn.
