Without prejudice to the first and second subparagraphs, international agreements with third countries and with international organisations, grant agreements, grant decisions and contracts resulting from the application of this Regulation shall contain provisions expressly empowering the Commission, the Court of Auditors and OLAF to conduct such audits and investigations in accordance with their respective competences.

1. The competent authority responsible for granting marketing authorisation shall verify whether an application for marketing authorisation or variation complies with the requirements laid down in Articles 7 and 8 and whether an application submitted pursuant to Article 30 complies with the agreed paediatric investigation plan.

Where an application for a marketing authorisation is submitted in respect of a medicinal product designated as an orphan medicinal product pursuant to Regulation (EC) No 141/2000 and that application includes the results of all studies conducted in compliance with an agreed paediatric investigation plan, and the statement referred to in Article 28(3) of this Regulation is subsequently included in the marketing authorisation granted, the ten-year period referred to in Article 8(1) of Regulation (EC) No 141/2000 shall be extended to twelve years.

67. Welcomes the progress made in the negotiations on the proposal for a regulation of the European Parliament and of the Council amending Regulation (EC) No 1073/1999 concerning investigations conducted by the European Anti-Fraud Office (OLAF) and repealing Regulation (Euratom) No 1074/1999 (COM(2011)0135); considers that this regulation should be adopted as soon as possible; is, however, convinced that in the light of the latest developments surrounding OLAF and the way its investigations were conducted, the recommendations of the Supervisory Committee set out in Annex 3 to its 2012 Annual Activity Report should be taken into consideration; finds it unacceptable that the Supervisory Committee, being the body that oversees the application of the procedural guarantees, respect for fundamental rights, and compliance by the OLAF staff with the internal rules on investigative procedures, has in a number of cases not been granted direct access to case files in closed investigations including the final investigation reports transmitted to the national judicial authorities;
67. verheugt zich over de geboekte vooruitgang in de onderhandelingen over het voorstel voor een verordening van het Europees Parlement en de Raad tot wijziging van Verordening (EG) nr. 1073/1999 betreffende onderzoeken door het Europees Bureau voor fraudebestrijding (OLAF) en tot intrekking van Verordening (Euratom) nr. 1074/1999 (COM(2011)0135); is van mening dat deze verordening onverwijld zou moeten worden goedgekeurd; is er - in het licht van de laatste ontwikkelingen rondom OLAF en de manier waarop OLAF zijn onderzoeken verricht - overigens van overtuigd dat de aanbevelingen van het comité van toezicht in bijlage 3 bij zijn jaarlijks activiteitenverslag 2012 in overweging moeten worden genomen; vindt het onaanvaardbaar dat het comité van toezicht, het orgaan dat erop toeziet dat de procedurele garanties worden geboden, de grondrechten worden geëerbiedigd en het OLAF-personeel zich houdt aan de interne voorschriften inzake onderzoeksprocedures, in een aantal gevallen geen rechtstreekse inzage heeft gekregen in dossiers in het kader van afgesloten onderzoeken, waaronder de definitieve onderzoeksrapporten die aan de nationale gerechtelijke instanties zijn toegezonden;

(11b) As regards VIS, Europol should be granted observer status at the meetings of the Management Board, when a question in relation to the application of Council Decision 2008/633/JHA of 23 June 2008 concerning access for consultation of the Visa Information System (VIS) by designated authorities of Member States and by Europol for the purposes of the prevention, detection and investigation of terrorist offences and of other serious criminal offences , is on the agenda. Europol should be able to appoint a representative to the VIS Advisory Group established under Article 16(1)(b).
(11 ter) Wat het VIS betreft, dient Europol de status van waarnemer te krijgen op de vergaderingen van de raad van bestuur, wanneer een vraagstuk op de agenda staat met betrekking tot de toepassing van Besluit 2007/533/JBZ van de Raad van 23 juni 2008 over de toegang tot het Visuminformatiesysteem (VIS) voor raadpleging door aangewezen autoriteiten van de lidstaten en door Europol, met het oog op het voorkomen, opsporen en onderzoeken van terroristische misdrijven en andere ernstige strafbare feiten Europol dient een vertegenwoordiger te mogen benoemen in de adviesgroep VIS die bij artikel 16, lid 1, onder b), wordt ingesteld.
