Recalls that the TRIPS provisions which call for some form of protection for plant varieties do not force developing countries to adopt the UPOV regime; stresses that those provisions do, however, enable countries to develop sui generis systems which are better adapted to the characteristics of each country’s agricultural production and to traditional farmer-based seed systems, while LDCs that are parties to the WTO are exempted from compliance with the TRIPS provisions concerned; emphasises that sui generis systems must be supportive of and must not counter the objectives and obligations existing under the CBD, the Nagoya Protocol and ITPGRFA.

4. Users acquiring Plant Genetic Resources for Food and Agriculture (PGRFA) in a country that is a Party to the Nagoya Protocol which has determined that PGRFA under its management and control and in the public domain, not contained in Annex I to the International Treaty on Plant Genetic Resources for Food and Agriculture (ITPGRFA), will also be subject to the terms and conditions of the standard material transfer agreement for the purposes set out under the ITPGRFA, shall be considered to have exercised due diligence in accordance with paragraph 3 of this Article.
4. In accordance with Council Decision 2004/869/EC , the International Treaty on Plant Genetic Resources for Food and Agriculture (ITPGRFA) was approved on behalf of the Union.
Bij Besluit 2004/869/EG van de Raad , is het Internationaal Verdrag inzake plantgenetische hulpbronnen voor voedsel en landbouw (International Treaty on Plant Genetic Resources for Food and Agriculture - ITPGRFA) namens de Unie goedgekeurd.

(2c) It is recognised practice to exchange all plant genetic resources for food and agriculture for the purposes of research, breeding and training under the terms and conditions of the Standard Material Transfer Agreement (SMTA) established under the International Treaty on Plant Genetic Resources for Food and Agriculture (ITPGRFA) as determined in the Memorandum of Understanding for the establishment of the European Genebank Integrated System (AEGIS); in accordance with Article 4.3 of the Nagoya Protocol, it is acknowledged that such a practice is supportive of, and does not run counter to, the objectives of the Convention and the Nagoya Protocol.

34. Calls on the Commission to instruct its negotiators in the WIPO IGC and the TRIPS review to consider the Nagoya Protocol as their point of departure and to focus in the negotiations on bringing in line the legal framework of the CBD and its Nagoya Protocol, WIPO, TRIPS, the ITPGRFA and UPOV , as well as UNCLOS with regard to maritime genetic resources; notes that the TRIPS agreement transitionally excludes Least Developed Countries ; stresses that this approach must be preserved with regard to any revisions that may result from the CBD-Nagoya process;
34. vraagt de Commissie om haar onderhandelaars in het intergouvernementeel comité van de WIPO en met betrekking tot de herziening van de TRIPS-overeenkomst op te dragen het Nagoyaprotocol te beschouwen als hun uitgangspunt en in de onderhandelingen aandacht te besteden aan het met elkaar in overeenstemming brengen van het wetgevingskader van het VBD en het Nagoyaprotocol, het WIPO-verdrag, de TRIPS-overeenkomst, het ITPGRFA en het UPOV-verdrag , evenals het UNCLOS-verdrag wat maritieme genetische hulpbronnen betreft; wijst erop dat de TRIPS-overeenkomst voorlopig geen betrekking heeft op de minst ontwikkelde landen ; onderstreept dat deze benadering moet worden gehandhaafd met betrekking tot eventueel uit het VBD-Nagoyaproces voortvloeiende herzieningen;
