D. whereas Article 16 of the EU Morocco Association Agreement, in force since 1 March 2000, provides that the European Community and Morocco will gradually implement greater liberalization of their reciprocal trade in agricultural products, processed agricultural products, fish and fishery products;

Such cooperation will in particular focus on the following: (a) market access and liberalization of trade, the study and stablishment of programmes for the reciprocal liberalization of trade, in particular the timetable and structure of negotiations, transitional periods, etc.; (b)tariff and non-tariff barriers, quantitative restrictions on imports and exports and measures having equivalent effect: analyses, studies and management, including quotas, administrative standards applied to external trade, anti-dumping duties, safeguard clauses, technical standards, health and plant health standards, mutual recognition of certification systems, etc; (c)the Parties' tariff structure; (d)compatibility of trade liberalization with WTO rules; (e)identification of potential tariff reductions and elimination of quasi-tariff measures; (f)definition of sensitive products and products given priority by the Parties; (g)cooperation and exchange of information as regards the rendering of services, within the Parties' respective areas of responsibility, on transport, insurance and financial services; (h)monitoring of practices restricting competition; (i)rules of origin which promote the use of regional inputs with a view to encouraging integration.
Deze samenwerking zal de volgende aspecten omvatten : a) de toegang tot de markt en de liberalisering van de handel, bestudering en planning van de vooruitzichten voor de toepassing van de wederkerige handelsliberalisering, met name de termijnen en regeling voor de onderhandelingen en de overgangsperioden ; b) tariefmuren en andersoortige belemmeringen, kwantitatieve import- en exportbeperkingen en maatregelen met gelijksoortige werking : analyse, studies en beheer, met inbegrip van contingenten, administratieve normen voor de buitenlandse handel, anti-dumpingrechten, vrijwaringsclausules, technische normen, sanitaire en fytosanitaire normen, wederzijdse erkenning van certificatiesystemen ; c) structuur van de douanetarieven van de Partijen ; d) verenigbaarheid van de handelsliberalisering met de normen van de WTO ; e) opsporing van mogelijkheden voor verlaging van de douanetarieven en afschaffing van pseudo-tariefmaatregelen ; f) aanwijzing van voor de Partijen gevoelige en/of prioritaire produkten ; g) samenwerking en uitwisseling van informatie inzake diensten, in het kader van de respectieve bevoegdheden van de Partijen, in het bijzonder in de sector vervoer, verzekeringen en financiële dienstverlening ; h) bestrijding van praktijken die de concurrentie beperken ; i) normen van oorsprong die bevorderlijk zijn voor het gebruik van grondstoffen uit de regio, ten einde de integratie te stimuleren.

Though it is too early to state in detail the components of such an association, the main lines would be: - the gradual establishment of a free-trade area for industrial products and services and, taking account of the sensitivity of certain products, reciprocal and gradual liberalization of agricultural trade; - cooperation and dialogue on trade issues; - the liberalization of trade in services and capital; - joint financing instruments for regional projects; - cooperation on environmental issues and transport; - cooperation on science and technology; - cooperation on information, communications and culture; - interinstitutional cooperation; - political cooperation and coordination in international forums; - industrial cooperation; - cooperation regarding the information society, information technologies and telecommunications.
Hoewel het nog te vroeg is om de elementen waaruit deze associatie bestaat exact te definiëren, zouden de hoofdlijnen van de associatie zijn : - flexibele en geleidelijke totstandbrenging van een vrijhandelszone op het gebied van industrieprodukten en een wederzijdse geleidelijke liberalisering van de handel in landbouwprodukten (waarbij rekening wordt gehouden met de gevoeligheid van bepaalde produkten). - samenwerking en dialoog inzake handelsvraagstukken; - liberalisering van het diensten- en kapitaalverkeer; - gezamenlijke financieringsinstrumenten voor regionale projecten; - samenwerking op het gebied van milieu, vervoer, wetenschap en technologie; - samenwerking op het gebied van informatie, communicatie en cultuur; - interinstitutionele samenwerking; - samenwerking en politiek overleg op internationale fora; - samenwerking op het gebied van de informatiemaatschappij, informatietechnologieën en telecommunicatie; - industriële samenwerking.

Within this area: - manufactured products would move freely, without tariff or non-tariff barriers; - taking as a basis traditional trade flows, and as far as the various agricultural policies allow, trade in agricultural products would be progressively liberalized, through reciprocal preferential access; - the right of establishment for companies, provision of cross-border services and capital movements would be progressively liberalized, having due regard to the GATS Agreement.
In dit gebied : - geldt vrij verkeer van industrieprodukten, zonder tarifaire of non- tarifaire belemmeringen ; - wordt, uitgaande van de traditionele handelsstromen en voor zover het respectieve landbouwbeleid van de partners zulks toelaat, de handel in landbouwprodukten geleidelijk geliberaliseerd via wederzijdse preferentiële toegang ; - krijgen vennootschappen het recht zich te vestigen en worden grensoverschrijdende dienstverlening en het kapitaalverkeer geleidelijk geliberaliseerd, rekening houdend met de GATS- Overeenkomst.

The Commission is therefore proposing an interregional association between the Union and Mercosur. 2. EU-Mercosur interregional association The long-term goal put forward by the Commission today is an EU-Mercosur interregional association founded on a balanced political, economic and trading partnership conducted in a spirit of solidarity, notably through the gradual establishment of a free-trade area for industrial products and services together with reciprocal and gradual liberalization of trade in agricultural products, taking account of the sensitivity of some products. Cooperation, political and otherwise, could be deepened at the same time.

De oprichting van een interregionale Associatie Europese Unie- MERCOSUR Het thans door de Commissie voorgestelde uiteindelijke doel is de totstandbrenging van een interregionale Associatie EU-MERCOSUR, gebaseerd op een evenwichting en solidair partnerschap op politiek, economisch en handelsgebied, met name via de geleidelijke totstandbrenging van een vrijhandelszone voor industrieprodukten en diensten, alsmede een wederzijdse geleidelijke liberalisering van de handel in landbouwprodukten (waarbij rekening wordt gehouden met de gevoeligheid van bepaalde produkten) en een nauwe samenwerking, ook op politiek gebied.

The monopoly as originally set up was absolute, covering all operations involving petroleum and refined products (exploration, refining, transport, storage, marketing, distribution, selling, importation and exportation. Under the Act of Accession of Spain to the European Communities, Spain was required to adjust its oil monopoly progressively from 1 January 1986 so as to ensure that by 31 January 1991 at the latest no discrimination regarding the conditions under which oil was procured and marketed existed between nationals of the Member States. On 29 July 1987 the Commission decided to initiate infringement proceedings since it considered that the provisions adjusting the monopoly and contained in Decree-Law No 5 of 12 December 1985, which was adopted by the Spanish authorities in fulfilment of Spain's obligations under the Act of Accession, were insufficient. After the Commission had issued a reasoned opinion, the Spanish Government undertook to adopt a detailed timetable for the liberalization of the monopoly. The Commission thus decided to suspend the infringement proceedings pending actual implementation of the measures announced. The new Law deals with the last remaining legal barrier, viz. the exclusive retailing rights enjoyed by CAMPSA, the Spanish enterprise responsible for operating the monopoly, and by extension, by the Spanish refineries forming part of the network of service stations subject to the monopoly. The exclusive wholesaling and retailing rights for the various oil products have now been adjusted as follows: - a system of fixed prices for motor fuels incompatible with the Treaty was replaced by a system of maximum prices that is acceptable in so far as it enables products refined in other Member States to be imported into Spain; - the prescribed minimum distances between service stations have been significantly reduced on two occasions and, pending the opening of the monopoly network to all operators in Spain (envisaged by the new Law), a par ...
Bij zijn instelling bestreek dit monopolie alle activiteiten op het gebied van aardolie (exploratie, prospectie, raffinage, vervoer, opslag, in de handel brengen, distributie en verkoop van de ruwe aardolie en de geraffineerde produkten, alsook de invoer en uitvoer daarvan).
