TRADUCTIONS EN CONTEXTE

While measures under the Radio Spectrum Decision are without prejudice to the rights of Member States to organise and use spectrum for public order and public security purposes (namely PPDR) , such use would benefit from a common frequency range in order to ensure free circulation of devices and interoperable services in line with the RSPP policy objective on spectrum availability.

In line with the objectives and principles of the radio spectrum policy programme to find ways to avoid harmful interference and increase the efficient use of spectrum, such harmful interference could be avoided through certain interference mitigation solutions such as the specific procedure for interference-free operation of wireless microphone and in-ear monitor links defined in Annex 2 to the addendum to CEPT Report 50 or by applying other mitigation solutions. Member States should, where appropriate, encourage the application of such interference mitigation solutions and agreements, including by providing assistance or guidance to the parties involved.

Member States should therefore take appropriate ex ante or ex post regulatory measures (such as action to amend existing rights, to prohibit certain acquisitions of rights of use of spectrum, to impose conditions on spectrum hoarding and efficient use such as those referred to in Directive 2002/21/EC, to limit the amount of spectrum available for each undertaking, or to avoid excessive accumulation of rights of use of spectrum) to avoid distortions of competition in line with the principles underpinning Directive 2002/20/EC and Council Directive 87/372/EEC of 25 June 1987 on the frequency bands to be reserved for the coordinated introduction of public pan-European cellular digital land-based mobile communications in the Community (the ‘GSM’ Directive).

In line with the objectives of the Digital Agenda for Europe, wireless broadband could contribute substantially to economic recovery and growth if sufficient spectrum were made available, rights of use of spectrum were awarded quickly, and trading were allowed to adapt to market evolution.
In lijn met de doelstellingen van de „Digitale agenda voor Europa”, kan draadloze breedband een wezenlijke bijdrage leveren aan economisch herstel en groei indien er voldoende spectrum beschikbaar is, de spectrumgebruiksrechten snel worden toegewezen en handel wordt toegestaan om in te spelen op marktontwikkelingen.

8. In order to avoid the possible fragmentation of the internal market due to divergent selection criteria and procedures for harmonised spectrum allocated to electronic communication services and made tradable in all Member States pursuant to Article 9b of Directive 2002/21/EC, the Commission shall, in cooperation with Member States and in accordance with the principle of subsidiarity, facilitate the identification and sharing of best practices on authorisation conditions and procedures and encourage sharing of information for such spectrum to increase consistency across the Union, achieved in line with the principles of technology and service neutrality.
8. Member States should: Develop and make operational national broadband plans by 2012 that meet the coverage and speed and take-up targets defined in Europe 2020, using public financing in line with EU competition and state aid rules[28], the Commission will report annually on progress as part of the Digital Agenda governance; Take measures, including legal provisions, to facilitate broadband investment, such as making sure that civil engineering works systematically involve potential investors, clearing rights of way, mapping available passive infrastructure suitable for cabling and upgrading in-building wiring; Use fully the Structural and Rural Development Funds that are already earmarked for investment in ICT infrastructures and services; Implement the European Spectrum Policy Programme, so as to ensure the co-ordinated allocation of the spectrum needed to meet the target of 100% coverage of 30mbps internet by 2020, and the NGA Recommendation.
De lidstaten dienen: tegen 2012 nationale breedbandplannen te ontwikkelen en ten uitvoer te leggen die voldoen aan de in de Europa 2020-strategie vastgestelde streefcijfers op het gebied van dekking, snelheid en gebruik en die qua overheidsfinanciering voldoen aan de mededingings- en staatssteunvoorschriften van de EU[28]. De Commissie zal jaarlijks in het kader van het beheer van de Digitale Agenda verslag uitbrengen over de geboekte vooruitgang; maatregelen, inclusief wetsbepalingen, vast te stellen ter bevordering van investeringen in breedband. Zo dienen zij ervoor te zorgen dat bij bouwwerkzaamheden systematisch potentiële investeerders worden betrokken en wordt voorzien in doorgangsrechten, het in kaart brengen van beschikbare, voor bekabeling geschikte passieve infrastructuur en de modernisering van inpandige bekabeling; ten volle gebruik te maken van de structuurfondsen en de plattelandsontwikkelingsfondsen die reeds zijn geoormerkt voor investeringen in ICT-infrastructuur en ICT-diensten; de NGA-aanbeveling ten uitvoer te leggen, alsmede uitvoering te geven aan het Europese programma op het gebied van spectrumbeleid met het oog op een gecoördineerde toewijzing van het spectrum dat nodig is om de universele dekking van 30 Mbps-internet tegen 2020 te garanderen.

* In line with the objective of fostering the coordinated introduction of innovative means to manage radio spectrum across Member States, the need for Community action on trading of spectrum rights will be assessed, based on an opinion by the RSPG [16] and on an independent study conducted for the Commission [17].
