13. Calls on the Commission to bring Italy without delay towards infringement procedures, according to Article 260 of the TFEU, in view to establish penalties that ensure the Italian authorities comply with the judgement of the Court, in particular making sure that the existing landfills comply with EU law; considers that it would be appropriate and in line with the sentence C-304/02 of the European Court of Justice, ordering Italy to pay both a lump sum as penalty the long-lasting continued violations of EU directives over the past years and a daily penalty from now on;
13. verzoekt de Commissie om tegen Italië onverwijld overeenkomstig artikel 260 VWEU inbreukprocedures aan te spannen teneinde straffen vast te stellen die moeten waarborgen dat de Italiaanse autoriteiten zich aan het arrest van het Europese Hof van Justitie houden en er met name voor zorgen dat de bestaande stortplaatsen aan de EU-wetgeving voldoen; acht het passend en in overeenstemming met de uitspraak in zaak C-304/02 van het Europese Hof van Justitie Italië te vragen een vast bedrag te betalen als boete voor de langdurige overtredingen van de EU richtlijnen in de afgelopen jaren, plus een dagelijkse boete vanaf nu;
