RECALLS that the clearing and settlement of securities transactions is a key area of financial integration in the EU where substantial progress needs to be achieved, in line with the Council conclusions of 25 November 2004 and 5 May 2006; TAKES NOTE of the Code of Conduct, WELCOMES the agreement reached by the Industry on the Code and CALLS FOR its swift implementation; RECOGNISES that the strategic approach by the Commission based on self-regulation is an attempt in trying to enhance competition and reduce costs for users of post-trading services; that the enforcement of the Code of Conduct needs to be closely monitored with a view to considering other measures, including regulatory actions, if progress is not satisfactory; that compliance with the competition rules must continue to be closely monitored; and that further steps by different parties will be necessary in parallel in order to enhance efficiency and soundness of post-trading infrastructures taking into account the evolution in the markets; INVITES the Commission to deepen its work in these key areas taking into account the Ecofin discussion on 10 October 2006 and review the state of progress as follows:

A prescriptive approach as outlined in the Commission proposal would prevent the mission of audit committees changing according to market requirements as such is currently the case. For example, if originally the audit committees mission was mainly to review accounts, they are now increasingly involved in decisions regarding the appointing and superseding external auditors, monitoring their independence etc. Therefore audit committees should remain part of national codes and should not be prescribed in a Directive at EU level.

Such adaptation must make it possible: - to take greater account of all the economic and social realities of the countries concerned and, among other things, assess the impact of the measures concerned on all men and women; - to contemplate direct, targeted budgetary support for countries whose external trade has been liberalized and whose currencies are freely convertible and transferable, so as to foster, in a context of financial restructuring, the implementation of effective, equitable and transparent budgets, in the light, inter alia, of the outcome of the negotiations on revision of the Lomé Convention; - to move from targeting counterpart funds towards more general allocation, as soon as progress has been made in improving the effectiveness of the monitoring instruments, programming and budget implementation, and as regards internalization of reviews of public expenditure; - to involve the States concerned more in the monitoring of implementation; - to ensure greater coherence of Union action in implementing all the Community instruments (indicative programmes, resources intended for adjustment, STABEX, and food aid); - to take account of external payment obligations when they have a lasting impact on poverty.
Op grond van deze aanpassing moet : - meer rekening gehouden kunnen worden met de totale economische en sociale realiteit in de betrokken landen, onder meer door te beoordelen welke gevolgen de betreffende maatregelen voor alle mannen en vrouwen hebben, - gedacht kunnen worden aan directe en gerichte begrotingssteun voor landen waarvan het buitenlands handelsverkeer geliberaliseerd is en waarvan de valuta vrij convertibel is en vrij kan worden overgemaakt, om de tenuitvoerlegging van doeltreffende, billijke en doorzichtige begrotingen te bevorderen als onderdeel van een financiële sanering, met name op grond van de resultaten van de onderhandelingen over de herziening van de Overeenkomst van Lomé, - van een vaste bestemming voor de tegenwaardefondsen op een meer algemene bestemming overgegaan worden zodra er vooruitgang geboekt is met doelmatigheid qua controle-instrumenten en begrotingsprogrammering en -uitvoering, alsook voor wat de internalisatie van de onderzoeken van de overheidsuitgaven betreft, - men de betrokken Staten meer betrekken bij de follow-up van de tenuitvoerlegging, - gezorgd worden voor sterkere samenhang van de acties van de Unie bij de toepassing van alle communautaire instrumenten (indicatieve programma's, voor de aanpassing bestemde middelen, STABEX, voedselhulp), - rekening gehouden worden met de externe betalingsverplichtingen wanneer deze blijvende gevolgen hebben voor de armoede.

In this context the guidelines for the sensible use of wetlands as agreed by the Parties to the Ramsar Convention [Kushiro, 1993] should also be taken into account; Undertakes to ensure that, when sites are proposed, the NATURA 2000 network is consistent with the need to preserve wetland habitats in accordance with the Birds and Habitats Directives; Considers it necessary to formulate an integrated policy on management of hydrological resources in terms of both quantity and quality within the wetlands and outside them, and draws attention to the possible importance here of the communication on Community water policy which the Commission will be submitting; Recalls the support it gave to the communication on coastal areas in its conclusions of 18 December 1995, and takes the view that, as in the case of coastal areas, insufficient consultation between all levels of responsibility is one of the main causes of the current situation of wetlands; Emphasizes the need to take wetlands into account when drawing up the Community's strategy for the conservation and sustainable use of biological diversity which the Council called for in its conclusions of 18 December 1995 concerning the Convention on Biological Diversity; Welcomes the necessary research, education and training efforts being made to ensure the protection of wetlands; Stresses the need for the state of wetlands to be observed and monitored and for information and experience in this field to be exchanged, and the role played by the European Environment Agency in this matter, taking account of existing work and mechanisms in this field, particularly under the Ramsar Convention; Advocates coordination and cooperation with third countries to encourage the wise use of wetlands under existing instruments; Expresses the wish that the Community's concerns regarding the wise use and conservation of wetlands should be taken into account at the next conference of the parties to the Ramsar Convention, which must be ...
