Pursuant to the provisions of article 287 of the Treaty on the functioning of the European Union (TFEU) and Article 49 of the Financial Regulation applicable to the 10th EDF as regards the application of the transition period between the 10th European Development Fund and the 11th European Development Fund until the entry into force of the 11th European Development Fund Internal Agreement, which also applies to previous EDFs, we have audited:

I. whereas in November 2009 Nigeria signed a UE Development Fund agreement, whose aim is to support governance, trade and peace actions in Nigeria; the agreement amounting to 677 millions of euros and providing that a large amount of funding is finalized to empower the internal governance and to guarantee peace and respect of human rights,

10. Urges the UE to monitor that funding to Nigerian government coming from the EU Development Fund agreement that Nigeria has recently signed is used to promote governance and guarantee the respect of human fundamental rights and rule of law;

Moreover, the Agreement provides an additional dimension to the Special Partnership between the EU and an important Peripheral Region Nation, and could complement a future Atlantic dimension to the EU’s Integrated Maritime Policy. There are also specific synergies with a number of European Development Fund regional development programmes.

This report approves the Commission's proposal to make two changes to the rural development financing mechanism in line with the December 2005 European Council’s agreement on rural development funding for the period 2007-2013.

Council Regulation (EC) No 1085/2006 (4) established an Instrument for Pre-Accession Assistance (IPA), Regulation (EC) No 1638/2006 of the European Parliament and of the Council (5) established a European Neighbourhood and Partnership Instrument, Regulation (EC) No 1905/2006 of the European Parliament and of the Council (6) established a financing instrument for development cooperation, Council Regulation (EC) No 1934/2006 (7) established a financing instrument for cooperation with industrialised and other high-income countries and territories and the Partnership Agreement between the members of the African, Caribbean and Pacific Group of States and the European Community and its Member States, signed in Cotonou on 23 June 2000 (8) (the ACP-EC Partnership Agreement) and the Internal Agreement establishing the financing of Community aid under the multiannual financial framework for the period 2008 to 2013 in accordance with the ACP-EC Partnership Agreement and the allocation of financial assistance for the Overseas Countries and Territories to which Part Four of the EC Treaty applies (9) (Internal ACP-EC Agreement), govern the European Development Fund.
