(d) "Chinese designated travel agency", shall mean any travel agency selected and designated by the National Tourism Administration of the People's Republic of China (CNTA).

Deplores the inadequate protection of IPR in China, and regrets the lack of specific means available to European businesses, and particularly SMEs, to counter IPR infringements effectively; welcomes the Commission’s decision to propose a review of the directive on the enforcement of IPR; calls on the Commission and Member States to defend IPR better in all multilateral organisations where China is a member (the WTO, the World Health Organisation(WHO) and the World Intellectual Property Organisation (WIPO)); wants China to continue to transpose into its national legislation current international law on the protection of IPR and, more specifically, to combat counterfeiting and piracy, and urges the Chinese authorities to ensure enforcement, especially at a regional level; regrets that China has not taken part in the negotiations on the Anti-Counterfeiting Trade Agreement (ACTA); urges the Commission and the Member States to step up customs cooperation in the EU and with third countries, particularly with China, on the seizure of counterfeit goods, and to simplify customs procedures; asks the Commission and the Member States to cooperate more closely with third countries on copyright issues and licensing;

Adopt appropriate legislative or administrative measures to ensure that cinematographic works forming part of their national audiovisual heritage are systematically collected, catalogued, preserved, restored and made accessible for educational, academic, research and cultural purposes, while respecting copyright and related rights, if these measures do not yet exist.

(34) Whereas this Directive should not prejudice further harmonization in the field of copyright and rights related to copyright and the collective administration of such rights; whereas the possibility for Member States to regulate the activities of collecting societies should not prejudice the freedom of contractual negotiation of the rights provided for in this Directive, on the understanding that such negotiation takes place within the framework of general or specific national rules with regard to competition law or the prevention of abuse of monopolies;
(34) Overwegende dat deze richtlijn niet in de weg staat aan verdere harmonisatie op het gebied van de auteursrechten, de naburige rechten en het collectieve beheer van dergelijke rechten; dat de aan de Lid-Staten gegeven mogelijkheid om de activiteiten van maatschappijen voor collectieve belangenbehartiging te regelen, de vrijheid van onderhandelingen over overeenkomsten ter zake van de in deze richtlijn toegekende rechten onverlet moet laten, mits die onderhandelingen plaatsvinden in het kader van algemene of specifieke nationale voorschriften inzake de mededingingsregels of de voorkoming van misbruik van monopolies;
