On the basis of duly substantiated requests, the Commission has granted specific derogations for Member States where exceptional national or local circumstances or cross-border frequency coordination problems prevented the availability of the band (Table 1).

Among its provisions, this agreement includes the possibility for national officials to be subordinated to the authorities of the other Member State, for the exercise of certain coercive powers on the territory of the other Member State, for participation in activities for the protection of persons and property on the territory of the other Member State, for the transfer and matching of DNA profiles, for simplification and extension of cross-border surveillance and hot pursuit, and for allowing surveillance also for the protection of persons and property.
In deze overeenkomst is namelijk in een aantal nieuwe mogelijkheden voorzien: nationale politieambtenaren kunnen onder het gezag van de autoriteiten van de andere lidstaat worden geplaatst, bepaalde dwangmaatregelen kunnen op het grondgebied van de andere lidstaat worden genomen, er mag worden deelgenomen aan activiteiten met het oog op de bescherming van personen en goederen op het grondgebied van de andere lidstaat, DNA-profielen kunnen worden uitgewisseld en vergeleken, grensoverschrijdende observatie en achtervolging worden vereenvoudigd en uitgebreid en observatie wordt ook mogelijk voor de bescherming van personen en goederen.
