It shall be ensured in the selection of the Data Protection Officer that no conflict of interest may result from the performance of his or her duty in that capacity and from any other official duties, in particular those relating to the application of this Regulation.

The term "conflict of interest" shall be interpreted, in line with the definition promoted by the OECD, as meaning a conflict between the public duties and private interests of an official, in which the official has private-capacity interests which could improperly influence the performance of his official duties and responsibilities.

3. The selection of the Data Protection Officer shall not be liable to result in a conflict of interests between his or her duty as Data Protection Officer and any other official duties, in particular in relation to the application of the provisions of this Regulation.
