The General Court erred in assessing the consequence of the application of the principles of legal certainty, the objectivity of the Community Plant Variety Office and equal treatment in relation to the decisions of the President of the Community Plant Variety Office in the examination of a new variety.

Article 9(1) of Commission Regulation (EC) No 1238/95 of 31 May 1995 establishing implementing rules for the application of Council Regulation (EC) No 2100/94 as regards the fees payable to the Community Plant Variety Office (2), sets out the level of the fee payable to the Community Plant Variety Office (‘the Office’), for each year of the duration of a Community plant variety right as provided for in Article 113(2)(d) of Regulation (EC) No 2100/94.

‘an official register of plant varieties’ shall be considered as a reference to the common catalogue of varieties of agricultural plant species or of vegetable species, or to any register compiled and maintained by the Community Plant Variety Office, or by an official body of the Member States of the Community or the European Economic Area, or of a contracting party to UPOV;

Commission Regulation (EC) No 1238/95 of 31 May 1995 establishing implementing rules for the application of Council Regulation (EC) No 2100/94 as regards the fees payable to the Community Plant Variety Office (2), fixes the fees charged by the Community Plant Variety Office (the Office), and the levels of those fees.
Bij Verordening (EG) nr. 1238/95 van de Commissie van 31 mei 1995 houdende toepassingsbepalingen van Verordening (EG) nr. 2100/94 van de Raad met betrekking tot de aan het Communautair Bureau voor plantenrassen te betalen rechten (2) is bepaald dat aan het Communautair Bureau voor plantenrassen (hierna „het Bureau” genoemd) rechten moeten worden betaald en is de hoogte van die rechten vastgesteld.

To enable the exploitation of a patented biotechnological invention, the Community Plant Variety Office can grant to the patent holder a compulsory licence for the use of a protected plant variety containing his invention.

(2) Test guidelines relating to the conditions for the examination of the varieties have been issued by the Administrative Council of the Community Plant Variety Office (CPVO) established by Council Regulation (EC) No 2100/94 of 27 July 1994 on Community plant variety rights(4), as last amended by Regulation (EC) No 1650/2003(5), in respect of certain species.
(2) De raad van bestuur van het Communautair Bureau voor plantenrassen (CBP), dat is opgericht bij Verordening (EG) nr. 2100/94 van de Raad van 27 juli 1994 inzake het communautaire kwekersrecht(4), laatstelijk gewijzigd bij Verordening (EG) nr. 1650/2003(5), heeft ten aanzien van bepaalde gewassen testrichtsnoeren inzake de eisen voor het onderzoek van de rassen gegeven.

The aim of the amendment is to clarify the provisions on actions for judicial protection against decisions of the Community Plant Variety Office or its Boards of Appeal before the Court of Justice of the European Communities and the Court of First Instance of the European Communities.
Doel van de wijziging is verduidelijking van de bepalingen betreffende de rechtsbescherming tegen besluiten van het Communautair Bureau voor Planterassen of de binnen dat Bureau ingestelde Kamers van Beroep bij het Hof van Justitie van de Europese Gemeenschappen en het Gerecht van eerste aanleg van de Europese Gemeenschappen.

The Council, on the basis of a proposal from the Commission, decided to renew for another five years the terms of office of the President of the Community Plant Variety Office, Mr Bart KIEWIET, as of 31 July 2001, and of the Vice-President, Mr José ELENA ROSSELLO, as of 28 February 2002.
